The New York Times reports:

The Indian government has asked Internet companies and social media sites like Facebook to prescreen user content from India and to remove disparaging, inflammatory or defamatory content before it goes online, three executives in the information technology industry say.

Top officials from the Indian units of Google, Microsoft, Yahoo and Facebook are meeting with Kapil Sibal, India’s acting telecommunications minister, on Monday afternoon to discuss the issue, say two executives of Internet companies. The executives asked not to be identified because they are not authorized to speak to the media on the issue.

About six weeks ago, Mr. Sibal called legal representatives from the top Internet service providers and Facebook into his New Delhi office, said one of the executives who was briefed on the meeting.

At the meeting, Mr. Sibal showed attendees a Facebook page that maligned the Congress Party’s president, Sonia Gandhi.  “This is unacceptable,” he told attendees, the executive said, and he asked them to find a way to monitor what is posted on their sites. [Link]

Medianama has a detailed analysis that tries to reason with the unreasonable Mr Sibal. Nikhil Pahwa notes:

The Indian government needs to have a more realistic approach to the Internet.

We’ve said this before and we’ll say it again – there is a dangerous trend that has emerged over the last year and a half, of the Indian government trying to monitor, identify and block digital (online and mobile) communications, and increasingly there is paranoia over their lack of control over the digital space. No laws are needed. This country is Kapil Sibal’s personal property. He can just summon Facebook officials to his office and ask, “What is this?” No prizes for guessing why this has come in a year where his government’s popularity took a nose-dive. If you are as outraged as I am, please do this to register our collective protest:

        1) Jawahar Lal Nehru : First prime of India. In Congress everyone (12 or 13 out of 14 regions head at that time) voted for Sardar Patel to be first prime minister. But Mahatma Gandhi dictated that Nehru should be first prime minister and dictatorship won.
        2) Indira pseudo Gandhi: King’s daughter became prime minister.
        3) Rajiv pseudo Gandhi: Queen’s son became prime minister.

        8) Comman man is looted by these politicians again and again, and yet no top leader is in jail, this is not democracy.

        Whether they are becoming prime ministers due to our indian mentality of liking kings/Queens rule or any other reasons but we are living in a pseudo Gandhi kingdom.

        I don’t know what is your definition of democracy. I know only one definition which I learnt in my civics books in school which is “government by the people, of the people, for the people”.
        But what I see is “government by the pseudo gandhis, of the pseudo gandhis and for the pseudo gandhis”.

Why did Gandhi advocate for Nehru against Patel? Why did Nehru get afraid of Potti Sriramullu’s suicide and created linguistic states? Why did Nehru side with the Communists after the Indo-China war in 1962 when the Congress had absolute majority in the Parliament? Why did Nehru tolerate the inflated TA bill of an Indian ICS officer? Could the country be the same if Gandhi had himself wielded the political power? We are a nation of lost oppertunities by opting for short-cuts and appeasements. While I agree with Omar Abdullah that the country should show some guts while dealing with China but that is only a half statement. Our political leadership should show some grit on the issues that devalue our sovereignity instead of chasing the followers of Baba Ramdev at midnight.

  2. Sibal despite his legal training demonstrates very poor understanding of libel law. To determine whether a written sentence is defamatory or not requires a competent Court to evaluate the full facts and context of the statement, its truth and falsehood, as well as what imputations a “reasonable person” can draw from the sentence.

    While I fully appreciate that no automated technology can do this well today (had it been the case, we might as well have had automated Courts replacing the human judges!) it is also impossible for employees of Facebook or Google or Microsoft to be able to do that, short of playing God or throwing dice ! Even though Sibal may be angry that his dear leader has been run down by a Facebook user, the anger should not be directed to service provider companies. This is wide off the target !

Kapil Sibal and his party seem to be very much perturbed on dirty messages and dirty photos of Sonia Gandhi, Manmohan Singh, Rahul, Digvijay Singh and other prominent leaders displayed on social networking sites like Facebook. Now Kapil Sibal on behalf of ruling Congress party is trying to build pressure on CEOs and important officials of Facebook, Google, Microsoft, Yahoo etc to censor news pertaining to Sonia Gandhi and other leaders. But these officials have refused to accept the request made by Kapil Sibal taking plea that they cannot encroach upon fundamental right of Freedom of speech granted to citizens.

    This is news published in Newyork times. Crores of users are submitting billions of messages and photo daily on these sites and hence it is very much difficult to have control on the same.

    As such Kapil is now trying to tight the screws of these social networking sites so that they may stop allowing criticism against their leaders. This is freedom of speech or democracy as preached by Kapil and his mentor Sonia Gandhi. Government is contemplating of introducing internet censorship. Of course the idea is good provided it is not used only for safeguarding prominent leaders of his party but for safety and security of the Nation.

    It is ironical that learned advocate Sri Kapil Sibal is worried about comments made on FB against Sonia Gandhi and other leaders of Congress Party who are scam master and who act against the spirit of common men but Mr. Sibal is not worried about terror activities going on in the country through these social networking sites. Naxals, Maoist, foreign based terrorist are openly using FB to spread their dirty network. FB is openly used for spreading anti national message. There is no control on users and neither has it seems to be practically possible.

    Learned advocate Sri Sibal is not worried about sharp fall taking place in cultural values in children due to misuse of FB like social networking sites. He is not aware how children of modern era are going away from study and spoiling their precious time on FB. He is perhaps not aware that even staffs in government offices are busy in chatting on FB even during office hours. The great flatterer is worried because dirty pictures of his colleagues in Congress Party are displayed on these social networking sites. He is not worried for the fact that even defense secrets are leaked to enemy nations through internet hacking only.

    I intend to request our leaders like Kapil to discard flattery and perform fully in the interest of the country without any bias towards opposition parties or Team Anna or Ramdeo if their suggestions are in the interest of the country. Government is made by the people, for the people and of the people of India, but unfortunately Kapil is using the government powers as if Government is of the ministers, by the ministers and for the ministers.

  5. What is also a problem is the complicity by choice or by coercion of these social networking sites. Will they disclose requests for ‘takedowns’? Or will they just delete accounts, per terms of service, and provide private information?

    I know that Twitter chose to publicly fight secret such requests by the US government. Will anyone else do the same here? Will the weak protection of law and strong influence of politics in India force them not to?

      I hope this incident serves as a wake up call.
      To wit: Despite what you may think, we do NOT have any US First Amendment style unconditional constitutional guarantee of free speech.
      Article 19 of the constitution conveniently has a ‘conditions apply’ clause that adds exceptions for, among other things, ‘public decency and morality’ and ‘public order’. That has been used as a catch all for censorship, since all that anyone has to do is to start rioting or protesting hysterically for the government to ban something citing that it ‘hurts sentiments’.

      Unless we root for the unrevokable right to complete, unanimous, guaranteed free speech as a constitutional amendment, dumbasses like Sibal will continue to trample on personal liberty.

  17. Soon there will be a new law introduced in this country that if there are two or more persons talking to each other, it will be mandatory to pre-screen their words. If the words are against Sonia, Rahul, Diggy or MMS, they will not be allowed to be passed to listeners. According to Indian Telecom Miniter, the law is just a solution to check offensive words, not censorship :)

  24. Presumably, hate speech is what bothers Mr. Sibal. Fair enough. Many other societies are also concerned about this and have put hate speech laws in place. However, such laws work by punishing the perpetrator *after* the crime has taken place. There is a case going on right now in the UK: see here.

    What Mr. Sibal wants is to vet the contents of articles and blogs before publication. There is a name for this: censorship. It is amazing that Mr. Sibal — a lawyer apparently — fails to recognize this and persists in claiming that he does not want censorship. Idiot is too kind a word for him.

    At any rate, why is he involved in this? This is a question of law and not communications and the minister in charge of law matters is Salman Khurshid. Why is Mr. Sibal doing Mr. Khurshid’s job? Has Mr. Khurshid asked him to deal with this issue?

    As a side note, this is typical of the way the Government of India functions. Everyone seems to think that everything is their responsibility. A few years ago, I remember Mr. Laloo Yadav, saying — while introduced the so-called Garib Raths — that this was to help the poor. I felt like telling him that it was not his duty to “help the poor.” He was the Railways minister and not the social welfare minister.

    The only result of everyone thinking that everything is their responsibility is policy confusion. It was vividly illustrated for me when a couple of years back, I took a trip (Delhi-Chennai) on the Garib Rath. I decided to see how many garibs I could find among the passengers in my compartment. As expected, I didn’t see even one.

Well, I think that there are several serious issues which need our honourable telecom minister’s attention.. false id’s being used for communication, hacking of important government mails,etc being some of them. So, I request that the government uses its energy in handling such important issues in the country rather than taking action on what the people are saying about the government on social networking sites and accusing them of trying to malign the government’s public image. Mr. Sibbal, the citizens of India are pretty intelligent to decide what is true and what is nonsense. So, kindly divert your attention and your ‘precious’ time in looking into other more important matters… You cannot stop people from expressing their views about the government… If you are facing problems and are not able to run the government properly, you should atleast be courteous in listening to the public’s view… It is afterall their right to express their views on the government and not a insult though I agree that it may be a threat to your govenment. Kindly try to improve things rather than looking for ways to shut people’s voices if you actually want them to refrain from speaking ill about the government. Kindly remember that in the true the sense, ‘Government is of the people, by the people and for the people.’

  35. This populous stand, displays a very immature and pre meditated stand on this policy. The governement merely asked of ways to remove infringing data. This notification dated 11 April(which I am sure known of you have read) by the ministry talk about an array of material and not only defamatory material. The law prohibits obscenity, profanity, defamatory material and cpyright infringing material. This meeting was not about the infringing article about the Congress. It was about 255 other things as well. I like how every one has blown up just one of those things.
    The minister does not ask the people not to criticize the governement that is your right. But he wants a method in place that checks profanne criticism.
    The best argument I see here is “it is against democracy” Let me remind you this has nothing to do with democracy. This is to do with a right under Article 19 of the constitution. This right is under check by the laws in place, which put a limit on obscenity, profanity and defamatory material. Defamation is a crime punishable by law with a 2 year improsonment.
    The minister did not lay down a new law but is merely finding ways to enforce those inplace.
    I would urge all of you to have a deeper understanding of the subjct before you take up these extrme views

  48. I do not intend to play Devil’s advocate for the sake of it .. I agree with Kapil Sibal on this view of his.. i have personally seen many obscene and provocative pages on facebook. So much so that they could very well be held as perpetrators of riots of serious nature. I may not be in the majority when i say this but freedom of expression doen’t mean you go on to display acts of blatant blasphemy or even bigotry in some cases. To create pages like “F*** India” or even “Pakistan S*****” is just not acceptable. Also, certain pages containing graphic depictions of Holy figures(for some may be not for all) in ridiculously intolerant and absurd ways just doesn’t do the spirit of freedom of expression any justice.

  53. On a more serious note, Kapil Sibal is NOT an idiot. Far from it. The biggest mistake that we – those who cherish our freedom of expression – can make is to dismiss Sibal and his ilk as idiots, and underestimate what they can do with their power. Sibal is an extremely shred politician who knows exactly which side of the bread is buttered. And the biggest fear is that he has the means to enforce what he wants. Facebook, Google and other such such corporations have their business interests to protect – and there is no reason to doubt that they might “fall in line” if they feel that their interests are threatened enough. Look at what happened in China, or in some of the middle-eastern countries.

    Sibal wants the social networking sites not to be critical of the great Soniaji or her brood, or of the Congress. And the next thing you know is that there are a slew of obscenity and comunalism-related court cases against those sites. Are we so stupid that we can’t see a pattern in this?

    Also, You can censor 100m+ internet users of india, and not 28lakh Group C bureaucrats.
