SUROKKHA ISTEHAR (Safety Manifesto), is a recently formed forum of theatre workers and individuals and organizations concerned with gender justice in Bangla Theatre. The forum was formed following a raging recent controversy arising from providing a forum to an accused in many sexual harassment cases. A deputation of Surokkha Istehar submitted a memorandum to the member Secretary, Paschimbanga Natya Akademi (the WB government body invested with the recognition and welfare of Bengal theatre groups) seeking immediate information about sexual harassment redressal mechanisms within the ambit of the Akademi, fair representation of all segments of the theatre workers’ community in the constitution of the Akademi as well as accountability of theatre groups and the Akademi in ensuring persons accused of sexual harrasment do not occupy positions of power within the Akademi, etc. 

Published below is the memorandum, containing more than 900 signatures, which also announces the launch of the forum, which seeks to offer assistance to survivors of sexual harassment in theatre spaces, to ensure gender justice in Bengali theatre, among others. 

The Memorandum submitted to Pashchimbanga Natya Akademi

Madam/ Sir,

Several recent incidents of sexual harassment happening in theatre spaces have greatly disturbed us. We intend to draw your attention to these incidents through this letter.

It is a research-based fact that most survivors of sexual crimes do not lodge police complaints or take legal actions. In the few cases that they do, the complainants have to overcome obstacles and social stigma for taking an offender to court, which is another big battle that they have to fight. So once someone comes forward and takes this huge leap, the legal aspect of the whole case becomes very important because everyone, including survivors who have been silent, hopes that justice will be served. But in recent times, we have seen that on several occasions, theatre directors and actors, who are undergoing trials for such crimes, have returned to stage and performed in public. We feel that this strongly compromises the security of the complainants and invokes an unsafe feeling within young and vulnerable people in theatre.

In organised sectors, such accused are temporarily suspended from work until the court proceedings are over. In unorganised sectors, the local committees see to the safeguarding of the survivors, following the guidelines of Prevention of Sexual Harassment (POSH) Act. Unfortunately, neither is happening in theatre spaces. As theatre workers and social activists, we are greatly alarmed to see the unsafe space that all theatre workers, especially women, people of marginalised gender and sexuality identities, minors and even children, are exposed to everyday while learning, rehearsing and performing. Since Paschim Banga Natya Akademi is the apex body of affiliation in Bengal theatre, we want to place our demands before the Akademi in the hope that it would hear us out.

Our demands are:

1.     We want to know the status of the Internal Committee (IC), as per the POSH guidelines, under the jurisdiction of the Akademi. We want that such a committee be immediately formed if it is not existing already. The said committee will work towards prevention of sexual offences in theatre spaces, providing safety and health support to survivors and ensuring temporary distance between the accused and the complainants.

2.     We want to be informed about the plans and programmes of the Akademi which it intends to take up to prevent sexual offences and ensure safety of women, marginalised people, minors and children in theatre spaces across districts.

3.     The Akademi gives out regular grants to different theatre groups, on which they are dependent. Many theatre groups participate in festivals organised by the Akademi. Hence, it is our demand that the Akademi must obtain written declarations from these groups that they have no association with any sexual offenders whatsoever, without which they may be denied all benefits that they are getting from the Akademi. If they fail to meet up to their declaration in future, all grants and privileges may be stopped until their compliance.

4.     We want to know whether there is enough representation of women and other marginalised (gender and sexuality s identities) theatre workers, as per standard laws applicable in formation of such bodies, in the working committee of Paschim Banga Natya Akademi. If not, we want a revamped committee as per rules applicable.

5.     Those members of the Akademi who

·       are accused in sexual offences

·       are undergoing trials in such cases in a court of law

·    have voluntarily declared themselves to be patrons of any sexual perpetrator are to be expelled with no delay.

6.     We have formed the platform ‘Surokkha Istehar’ to protect the rights of theatre workers, especially of women and marginalised (gender and sexuality identities) persons against sexual harassment. We are ready to work in association with the Akademi for the proper realisation of these goals. We want to go into dialogues with the Akademi whenever that is required. We want that the Akademi would also extend its full assistance towards this forum in its various plans and programmes for sensitisation of theatre communities against sexual harassment at work space.

We hope that you would understand and appreciate our concern in the present situation and take steps to address the various issues that we have put forward.

সাম্প্রতিক কালে বাংলা নাট্যজগতে ঘটে চলা একের পর এক যৌন হেনস্তার ঘটনায় বিচলিত হয়ে আমরা এই চিঠির মাধ্যমে আপনার/আপনাদের দৃষ্টি আকর্ষণ করছি। একাধিক গবেষণায় দেখা গেছে যে ভারতবর্ষে যৌন হেনস্তার খুব কম ঘটনাই আদালত পর্যন্ত যায়। আদালতে নিয়ে যাওয়ার জন্য অভিযোগকারীদের অনেকরকম প্রতিকূল পরিস্থিতির মধ্যে দিয়ে যেতে হয়। আশা করা যায়, এমন বেশ কিছু ঘটনা আইনের আওতায় এলে, এই ধরণের অন্যায় বন্ধ করার জন্য আইনত উপযুক্ত ব্যবস্থা নেওয়া হবে। আমরা যারা চাই এই ধারাবাহিকভাবে চলতে থাকা যৌন হেনস্তার ঘটনা বন্ধ হোক, তাদের কাছে সেজন্য বিচারাধীন ঘটনাগুলি বিশেষভাবে গুরুত্বপূর্ণ। গুরুত্বপূর্ণ সেই মানুষগুলিও, যারা নিজের দায়িত্বে আদালত অব্দি গেছেন।  নাট্যজনেরা নিশ্চয়ই চান যৌন হেনস্তা বন্ধ হোক, নির্বিঘ্নে অল্পবয়েসি ছেলে মেয়েরা নাটকের কাজ করুক। অথচ যৌন হেনস্তায় অভিযুক্ত এবং বিচারাধীন বেশ কিছু অভিনেতা ও পরিচালককে একাধিক বার বিচার চলাকালীন অবস্থাতেই মঞ্চে ফিরতে দেখা গেছে। এর ফলে অভিযোগকারীদের (ও অন্যান্য অল্পবয়েসি নাট্যকর্মীদের ) সুরক্ষা সরাসরি বিঘ্নিত হচ্ছে। সংগঠিত কর্মক্ষেত্রে এইরকম বিচারাধীন অভিযুক্তদের সাময়িকভাবে বহিষ্কার করা হয়ে থাকে। অসংগঠিত ক্ষেত্রেও Prevention of Sexual Harrassment (POSH) আইনের ব্যবহারের মাধ্যমে Local Committeeর হস্তক্ষেপে অভিযোগকারীদের সুরক্ষার উপযুক্ত ব্যবস্থা নেওয়া হয়। কর্মস্থল হিসেবে নাট্য পরিসরের অবস্থান নির্দিষ্ট না হওয়ার কারণে এখানে আপাতত এর কোনটাই হচ্ছে না।  অভিযোগকারীদের এবং সাধারণ নাট্যকর্মীদের, বিশেষত মহিলা ও যৌন প্রান্তিক মানুষ, নাবালক ও শিশুদের সুরক্ষা নিয়ে নাট্যকর্মী, সমাজকর্মী ও নাট্য জগতের শুভানুধ্যায়ী হিসেবে আমরা শঙ্কিত বোধ করছি।পশ্চিমবঙ্গে নাট্য চর্চার প্রধান অভিভাবক সংস্থা  পশ্চিমবঙ্গ নাট্য আকাদেমি। এই ব্যপারে নাট্য অকাদেমির হস্তক্ষেপের আশা রেখে এই চিঠি।

আমাদের দাবীগুলি এই –

১। নাট্য আকাদেমির আওতায় POSH সংজ্ঞায়িত অন্তর্বর্তী কমিটির (IC) উপস্থিতি সম্পর্কে তথ্য প্রকাশ করতে হবে ,  এবং তার অবর্তমানে তা গঠন করতে হবে অবিলম্বে। এই অন্তর্বর্তী কমিটি থেকে যৌন-হেনস্তা রোধ, নির্যাতিত নাট্যকর্মীদের সুরক্ষা, শুশ্রুষা এবং সেই লক্ষ্যে অভিযুক্তদের থেকে সাময়িক দূরত্ব বজায় রাখার ব্যবস্থা করা হবে। 

২। কলকাতা তথা পশ্চিমবঙ্গের সমস্ত জেলাগুলিতে মহিলা ও যৌন প্রান্তিক নাট্য কর্মীদের সুরক্ষার জন্য ও নাট্যপরিসরে যৌন হেনস্তা বন্ধ করার লক্ষ্যে পশ্চিমবঙ্গ নাট্য আকাদেমি আগামী কি পদক্ষেপ নিতে চলেছে সে বিষয়ে আমাদের অবগত করার অনুরোধ জানাচ্ছি।

৩। পশ্চিমবঙ্গের বহু নাট্যদল তাদের নাট্য চর্চার জন্য পশ্চিমবঙ্গ নাট্য আকাদেমির অনুদানের ওপর নির্ভরশীল। নাট্য আকাদেমির বিভিন্ন উৎসবের মাধ্যমেও তাঁরা দর্শকের কাছে পৌঁছে যাওয়ার সুযোগ পান। আমাদের প্রস্তাব – আপনারা এই নাট্যদলগুলির থেকে যৌন হেনস্তাকারী ব্যাক্তিদের সঙ্গে সমস্ত সংসর্গ পরিত্যাগ করার লিখিত প্রতিশ্রুতি দাবী করুন এবং তা অনাদায়ে নাট্য আকাদেমি থেকে প্রাপ্ত তাদের সকল সুযোগ সুবিধাগুলি স্থগিত করুন।

 উপরোক্ত প্রতিশ্রুতি দেওয়ার পরেও তা পালনে অক্ষম হলে, আপনারা সেই নাট্যদলের বিরুদ্ধে যথোচিত শাস্তিমূলক পদক্ষেপ গ্রহণ করুন ও কিছু বছরের জন্য তাদের সমস্ত সুযোগ সুবিধা রদ করুন।

৫। পশ্চিমবঙ্গ নাট্য আকাদেমির কার্যকরী সমিতির গঠনে মহিলা ও যৌন প্রান্তিক মানুষ তথা প্রান্তিক পরিচয়ের মানুষদের যথেষ্ট প্রতিনিধিত্ব রয়েছে কি না, তা আমাদের জানানো হোক। না থাকলে সেই মর্মে ভারতীয় আইন ও সংবিধান মেনে কমিটির প্রয়োজনীয় রদবদল করা হোক। 

৬। পশ্চিমবঙ্গ নাট্য আকাদেমির উপস্থিত কার্যকরী সমিতির সদস্যদের মধ্যে যারা যৌন হেনস্তায় অভিযুক্ত / বিচারাধীন বা অভিযুক্ত যৌন হেনস্তাকারী দের মূল পৃষ্ঠপোষক বলে তাদের দ্বারাই ঘোষিত হয়েছেন আমরা তাদের বহিস্কারের দাবী করছি। 

৭। নাট্য পরিসরে যৌন হেনস্তা রুখতে এবং মহিলা, নাবালক, শিশু ও যৌন প্রান্তিক সমস্ত নাট্য কর্মীর সুরক্ষার লক্ষ্যে আমরা “সুরক্ষা ইশতেহার” ফোরামটি তৈরি করেছি। এই কাজের বাস্তবায়নে পশ্চিমবঙ্গ নাট্য আকাদেমিকে সমস্ত রকম সাহায্য করতে ও পরামর্শ দিতে আমরা প্রস্তুত এবং এই বিষয়ে মুখোমুখি  আলোচনা করতেও আগ্রহী। এর সঙ্গে নাট্য পরিসরে যৌন হেনস্তা ও শোষণ মূলক ব্যবহার রুখতে  এই ফোরামের প্রস্তাবিত নিজস্ব সচেতনতা ও শুশ্রুষামূলক প্রকল্প গুলিতে আমরা পশ্চিমবঙ্গ নাট্য আকাদেমীর পূর্ণ সহায়তা পাব বলে আশা করছি।

আমরা আশা করবআপনি/ আপনারা আমাদের উদ্বেগকে গুরুত্ব দিয়ে, নাবালক, শিশু, মহিলা, যৌন প্রান্তিক – তথা সমস্ত প্রান্তিক নাট্যকর্মীদের সুরক্ষার বিষয়ে যথোচিত পদক্ষেপ গ্রহণ করবেন।
