Is the judiciary being internally hijacked to usher in Hindu Rashtra?

There are a very few legal scholars or advocates who have perceptively looked at the dynamics of India’s judiciary and cautioned us about the dangers that can come our way through those routes only.
Dr Mohan Gopal, is an exception.
This noted scholar who has been very clear about the worldview and strategies of the Hindutva Supremacist forces to achieve the goal of establishing Hindu Rashtra, explains their strategy of executing it “not by overthrowing the Constitution but by interpretation by the SC as a Hindu Document”
Speaking in a programme organised by Live Law, Gopal had explained its dynamic as a two-step process:
One, appointing judges who are ready to look beyond the Constitution.
Two, how with an increase in the number of theocratic judges who find the source of law in religion rather than the Constitution, it will be easy to declare India as a Hindu theocracy under the same Constitution.

Similar to DJT and his cohorts who already have 6 in THEIR Supreme Court.They have so far given multiple judgements favoring them.After his almost certain victory on 5th, he will immediately set about commencing the destruction of his country—initially and then the RoW.

The complex socio- cultural phenomenon of India offers ample entry points for conspiratorial politics.Particularly since Independence, the socalled Right,ie, intrinsically anti- humanistic outfits have infiltrated the secularist mainstream .Nehru had had a really hard time fighting these vested and determined interests on several fronts.
With the advent of the non- congressism accompanied by SVD govts. in several states around 1967, the Sangh Parivar had started boldly putting its acolytes in all walks of governance. Recruited at the lower rungs, the Sangh loyalists kept ascending the higher positions. After Emergency ended, the Sangh was able to use its position of authority to further recruit its loyalists, bolstered again during the V P Singh regime, Atal regimes, and now since 2014 Modishahi.
Judiciary, as well as every branch of governance and administration is now packed with those promotees or fresh inductions.
The Congress ,itself infested by the Sangh ilk, has always been either oblivious or complicit in contaminating the ideally- cherished secularist polity.
But the culprits are not the secularist political groups alone. We, the people of India, have failed in our vigilance– the enlightened, well bred well fed, educated classes, as well as the not- so – fortunate masses who were used as mere instruments to gain and retain power.
And we are now paying for our sins of omissions, helpless in the clutches of PIOUS Judiciary and omnipotent executors.

You have really hit the nail on its head
Nehru – who had been clear about the design of the Hindutva Supremacists to usher us into Hindu Rashtra – having ‘hard time fighting these vested interests‘ or failure of ‘enlightened, well fed people of India‘ to remain vigilant – both the points are very important.
It should be a matter of concern for all thinking people that a society that was far less developed and far less educated than it is today gave rise to leaders like Gandhi, Nehru, Maulana Azad, Ambedkar and Bhagat Singh, gave itself a Constitution like the one we have, and offered itself prospects of an enlightened democracy despite its poverty and backwardness. And a society now that is better fed and better educated – where democracy has become relatively entrenched and far more energetic – has brought upon itself the threat and the disaster of a majoritarian authoritarianism and a bigoted, fascistic leadership.
One does not find oneself convinced by partial explanations that put all explanatory burden on this or that mistake of a leader or of a political agency. It has become clearer with the passage of time that the social and political playing field itself has become increasingly tilted against the enlightened, liberal and progressive forces, let alone the leftist and socialist forces.
