Corruption has its Caste in the Judiciary: All India Confederation of SC/ST Organisations

Dr. Udit Raj, National Chairman of All India Confederation of SC/ST Organisations, said that corruption has its caste. The way the former Chief Justice of India, K. G. Balakrishnan and former Chief Justice of Karnataka, P.D. Dinakaran, are being treated, there is no doubt that corruption knows the caste. Here argument is not to absolve these people but to expose hypocrisy and double speak. The Supreme Court hastened to admit petition against K.G. Balakrishnan but why not in other cases?

Dr. Udit Raj further said that when Dr. A. S. Anand was Chief Justice of India in 2000, an affidavit through his wife was manipulated in Madhya Pradesh to claim the compensation of about 1 crore. Not only this, he tampered with date of birth. The lawyers who helped in getting the compensation, were rewarded and inducted into High Courts. A senior journalist, Vineet Narayan, wanted to bring impeachment against him but politicians got afraid and did not co-operate with him. Then he appealed to the President of India, K. R. Narayanan, and, in turn, he sent to the Law Minister, Ram Jethmalani. This law minister acted and asked for comments from Dr. A. S. Anand. Then Prime Minister, Atal Behari Vajpayee and BJP leader, Arun Jaitley came to his rescue and Jethmalani had to go. Such a huge difference is obvious while treating dalit vis-a-vis so called upper castes. The poor Vineet Narayan was made a scapegoat and Mr. Anand got instituted defamation case in Jammu and Kashmir High Court. It was deliberately to teach a lesson to Vineet Narayan as he was already the target of terrorists. Jammu and Kashmir was not safe for him. His house and office were raided and as a result, he fled away to foreign country. Till date, all corruption matters against Dr. A. S. Anand are pending and no one is there to rake them up. Thus there is huge benefit to be so called upper caste and specifically in Higher Judiciary. Dr. Anand not only successfully superannuated but was rewarded with Chairmanship of NHRC.

Dr. Udit Raj told that another so called upper caste CJI, Y. K. Sabbarwal’s case will illustrate that corruption is not an issue. In collaboration with builders and realtors in Delhi, he passed such judgments that hundreds of colonies and lakhs of houses and shops were sealed. Innumerable people were pushed to poverty and hunger and articles and expensive wares were rotten, destroyed and rusted in the sealed houses. His sons operated corporate activities from his house. Later on, they purchased a property on Sikandar Road, Connaught Place, N.Delhi worth about 100 crores. So far, corruption has not been established against K. G. Balakrishnan and even if there is something, then why Sabharwal was not meted out the same treatment?

Who doesn’t know the famous scandal of provident fund in Ghaziabad. The main witness of this case died in the jail and after that there was no hue and cry and so far his death is a mystery. The case is being tried in CBI court, the so called honourable judges don’t even bother to attend the hearings. The name of Tarun Chaterjee surfaced in the scandal when he was judge in the Supreme Court. Other judges’ names are also involved in this scandal. What happened to the media in these matters? P. D. Dinakaran cried that he was open for enquiry, the Bar Association, Media and Judges did not wait till the outcome of proper enquiry and he was punished. Not only he was deprived of his work, he was transferred to an insignificant place. Had he not been a dalit, he would have not have been meted out such treatment. What happened to that judge in Rajasthan when he remarked in the case of rape of dalit lady, Bhawari Devi that how can an upper caste commit rape ? Yet another case of Dalit judge, Sushila Nagar in Rajasthan is landmark as to how how she was harassed and humiliated? Her progressive husband who was in the same position in the judiciary ,had to resign and take up social mantle. There are thousands of such cases against so called upper caste judges but why there is no haste and activism on the part of media, judiciary, govts., bar associations ? Why there are two standards for corruption?

So far, hundreds of judges have been appointed in the Supreme Court and till today only three have been from dalit background. Thousands of judges have been appointed in the High Courts and only few were from dalits and backward community. Proportionately higher caste judges are more and if objectivity was observed in corruption matters, large number of heads would have rolled by now. There is no examination and set standard to make a lawyer a judge. This goes without saying that their appointments are quite subjective. The appointments are mainly done on the basis of nepotism, favouritism, casteism. Can we expect speedy and fair judgments in these circumstances?

    The judiciary which commands a lot of respect today despite all these scandals surfacing from time to time is without doubt the most incestuous bunch of self promoters. You only have to see the number of people who are at the top who have had fathers, grandfathers and uncles who have occupied positions at the top to realize how deep rooted nepotism is in the judiciary. The judges call each other brother judges. The same protection that judges afford to their upper caste brothers is not being given to the dalit brothers.

    It is also laudable that you say at the outset that this is not to absolve Dinakaran or KGB. I don’t know about KGB but in the case of Dinakaran it is partly his own doing. In my personal experience he was very rude and humiliated his own secretaries and staff in front of me. I felt sorry for them. When a judge behaves rudely with a lawyer he is only being obnoxious, but when he pisses off his own staff he grows a poisonous snake at home which is sure to bite him one day.

    The judiciary is a hot bed of hypocrisy. It wanted all the government agencies to be under the purview of the Right to Information act but would not subject itself to such scrutiny. It wants the entire country to have reservations but it will not agree to reservations in the judiciary itself. It wants all appointments to other positions to take place after a proper open process but won’t agree to have an open process themselves.

  2. How about Mr.Veerasamy former Chief Justice of Madras High Court. When his house was raided by CBI and a case was filed against him he used all loop holes in the law to delay the
    case being conducted and finally won on a technical ground. He had supporters like Udit Raj who alleged that he was vicitimised as he was from a OBC.Ditto with his close relative V.Ramaswamy against him impeachment motion was brought.The same argument that he was a victim because he was from a OBC was put forth.Prashant Bhushan and others who are fighting against corruption in higher judiciary have not spared anyone on account of caste.Sohail Hashmi should have known know this before putting up such aguest post in Kafila and can check the details in the website they maintain. There are more details there including details about Justice Ashok Kumar.
    Dont think that we are fools to buy the arguments put forth by Udit Raj&Co. Just recently
    WikiLeaks revealed how greedy an ex-minister was in matters relating to Dow Chemicals.
    He too used the bogey of being dalit but whose interest was he serving. In this country corruption knows no caste and dont bring caste to defend the indefensible elements.
    In case of Justice Dinakaran it was the progressive and lawyers from the left parties who exposed his property details and instances of land grabbing when he was about to be elevated to SC. The state govt. gave a report that vindicated their investigation. Udit Raj and Co should not lie like this because the response from Justice Dinakaran was well known and how his being a Dalit was used a bogey.High Court judges- a good portion of them are promoted so from judicial officers serving in district courts and in many states there is reservation for SC?ST?OBCs in those posts. So a OBC being promoted as a HC judge is not new. In some states atleast there are many judges from OBCs.
    Finally can Sohail Hashmi tell us as to what has been the record of Udit Raj &co in these issues as Sohail has taken the role of their ‘advocate’ in kafila by guest posting it.. have they fought against corruption per se or against corruption in judiciary.
    How many PILs they have filed to expose corruption or on other public issues. What is their agenda in these.

    So much talk about corruption now, a cancer the society is struggling with.. its true that it needs to be eliminated. however, i share the concerns of the author that corruption is caste. No that a dalit or obc cant corrupt.. my only concern is just do a small survey about the public trial done on different corrupt people sofar, see the caste profile them.. invariably you would find majority of them would be dalts and OBCs.. but question is their representation in the state machinery is not even crossing 20%keeping aside politicians because that is matter of numbers. Now coming to the fact, that how come no of cases filed or publics trial done in the cases to seem to be more in the slot of 20%,, but it is so less in the 80% cake.. may be one has check that gene of SCs and OBCs as to why they tend to be more corrupt than others if your so called media and civil society so neutral..

    So much progressive talk… Now A Raja is in Jail for 2g Scam, good, let the rule of law prevail.. What about Buddhdev Bhattacharya, the same Nire radia was cosultant for WB govt.. let the public know about the converstaion…..

    there are numerous cases, including politicians say there is clear demarcation.. for example there is one treatment for mayavathi, lalu, karunanithi, paswan, mulayam..and soft melo treatment to Rajiv gandhi, jayalalitha, Narasimha rao, R. Venkatraman, and Vajybayee…
    Can any one deny the double standard??? just do survey… will get to know the rotten castiesm in everywhere including civil society in dealing with the corruption cases?

Hindus are corrupt up to neck whether it is Judiciary ,politics or defence.there is no resevation in higher judiciary but 50% of supremecourt judges are corrupts .our Shantibhusan and sons are not dare to chalange the Mr Anand of sabharwal.India is being ruled by hindus criminals who are supported by hindu judges in higher judiciary.160 million dalits will get justice in their own county and not with hindus.All dalit intellectuals should join together and demand for seprate electorate and seprate settlement away from Hindus.

  6. Articles like the one above leave one with the uncomfortable feeling that some people can see only through caste spectacles. Is it not a fact that the corruption of some of the people belonging to the so called upper castes has been pointed out and attacked by those who belong to ‘upper castes’? And they are the ones who have pointed out the acts of corruption done by those who are being considered as belonging to the dalit community.

    Corruption is inexcusable no matter who is responsible. Let us not attack those men of integrity who point out corruption committed by all people irrespective of their caste in order to indirectly protect those whom we consider ‘ours’. Many of us are now what Gopal Krishna Gandhi calls trans caste and feel uncomfortable when attempts are made to look at things only with caste labels. By all means attack those who victimize people due to their caste. But let us not defend in a round about fashion those who are wrong just because they belong to a particular caste. If they are innocent an inquiry will surely establish it and there will be mud on the face of those who unjustly accused. It is difficult to convince people who have made up their mind but facts do remain facts.

  8. भ्रष्टाचार पर सुप्रीम कोर्ट नें सभी मामलों में आवश्यक कार्यवाही की है । अगर सुप्रीम कोर्ट के फैसला शक के दायरे में है तो फैसले के खिलाफ रिव्यू पिटीशन दाखिल की जानी चाहिए । क्या रिव्यू पिटीशन दाखिल होगी?
