Why the Delhi Police Special Cell will continue to manufacture terrorists: JTSA

This release was put out yesterday by the JAMIA TEACHERS’ SOLIDARITY ASSOCIATION

Last year, JTSA compiled and released a report documenting 16 cases where the Delhi Police, especially its Special Cell, had framed innocents as terrorists. An overwhelming number of these unfortunate men were from Kashmir. Despite the fact that we cited court judgements which reprimanded the Cell for refusing to join independent witnesses, for willfully violating established procedures, for illegally detaining accused and showing their arrests on later dates; for fabricating evidence and failing to provide an iota of evidence in support of their charges – neither the leadership of the Delhi Police nor the Home Ministry felt the need for any enquiry. Kazmi Solidarity Committee welcomes SC order to grant bail to Syed Kazmi

The Kazmi Solidarity Committee welcomes the Supreme Court order granting bail to Syed Mohammad Ahmad Kazmi after seven months in custody on charges of involvement in the bomb attack on an Israeli diplomatic vehicle.

The committee deplores the obstructive attitude of the prosecution and the Special Cell of the Delhi Police, which have been perversely attempting to keep Mr. Kazmi in prison despite their inability to file a chargesheet within the extended time granted under the Unlawful Activities Prevention Act. Not only did the prosecution seek an extension of 90 days after the mandated period of judicial custody was over, it also used its inefficiency as an alibi, pleading that it needed more time to send out letters rogatory seeking international judicial assistance. While Mr. Kazmi was in custody, the Special Cell left no stone unturned in orchestrating a media trial to establish his guilt, planting malicious stories of his “confession” (while disavowing responsibility for these in court hearings).

It is now attempting desperately to defend the indefensible by hiding behind a maze of statistics, ignoring the real questions that the report has raised: namely the brazen and systematic violation of all established legal norms and due process. An RTI enquiry has revealed that Delhi Police Special Cell’s conviction rate is a paltry 30 per cent. Nearly 70 per cent of the accused it charge-sheeted over the past five years were acquitted for want of credible evidence. Do these figures tell us something? A news story in a leading English daily bemoans this trifling record and quotes a senior police officerattributing this to the fact that “police sometimes get tangled in cross evidences and it becomes tough when you rely more on circumstantial evidences”. [i] This evokes the image of a bumbling policeman, reminiscent almost of Jacques Clouseau, tripping over reams and strings of evidences, in an impossible attempt to build a watertight case against the villains. Veteran of fake encounters must be suspended immediately!

It seems there is no end to Special Cell’s gallantry. One of its most celebrated and decorated heroes, Ravinder Tyagi, also the key architect of the Batla House ‘encounter’ has been found guilty of yet another frame-up of innocents as terrorists. The additional sessions judge Virendra Bhat yesterday absolved and acquitted seven men accused of terrorism in a case dating back to 2005; while pronouncing four officers of the Delhi Police guilty of manufacturing a fake story about an ‘encounter’. The Police had claimed to have recovered AK-47 assault rifles, fake currency and ammunition from the men they claimed were ISI agents—a brazenly false claim. Look who’s talking (to whom): FBI and Special Cell

Wikileaks has exposed that there existed secret channels of communication between the US agency FBI and our very own Delhi Police Special Cell. FBI—which has witchhunted American democratic and civil rights organizations and leaders (including Martin Luther King Jr.), raids the homes of anti-war activists, and helps the overthrow of popular governments around the world—and Special Cell whose personnel have been indicted in the past, by none less than the CBI, for manufacturing ‘terrorists’ out of thin air by planting false evidence; an organization often accused by rights activists of killing in cold blood, a.k.a. ‘encounters’, for medals and promotions. What possible information were they sharing in secret? Who to frame and fix next?
