Beyond Reasonable Doubt? The Conviction of Shahzad Ahmad is a detailed analysis and critique by the Jamia Teachers’ Solidarity Association of the judgment awarded on the 25th of July by the 2nd Additional Session Judge, Delhi-South East (Saket) Court in the ‘State vs. Shahzad Ahmad@Pappu’ case, also known as the ‘Batla House Encounter’ case. Yesterday, on the 30th of July, the judge confirmed his verdict of ‘guilty’ and awarded Shahzad Ahmad the punishment of imprisonment for life and a fine of Rs. 95,000/-. The JTSA, which has been following the Batla House Encounter since 2008 presents its findings on the trial in this booklet, and disputes the guilty verdict awarded to Shahzad Ahmad. The Batla House Judgement and the Impossibility of Closure

The word ‘closure’ has a reassuring, comforting resonance, particularly when it comes to matters of death. One achieves closure. It is granted.  Those who are fortunate receive it as recompense for the necessary tasks of grief and mourning. We move on.

On the 25th of July, last week, after Rajender Kumar Shastri, 2nd Addiitional Sessions Judge of the South East (Saket) Court in New Delhi announced in open court that a young man named Shahzad Ahmad of Khalispur village in Uttar Pradesh’s Azamgarh Disttrict was guilty of causing the death of Inspector Mohan Chand Sharma of the Special Cell of the Delhi Police in Flat No. 108, L-18, Batla House, in South Delhi’s Jamia Nagar on the 19th of September, 2008, the word ‘closure’ began to ring out on prime time television.  We were given to believe that the infamous ‘Batla House Encounter’ case had finally achieved closure. That the ‘martyrdom’ and sacrifice of Inspector Mohan Chand Sharma had now been vindicated. That all unseemly controversy could now be put to rest. We were told that it was time to move on.

JTSA lists some more ‘genuine’ encounters in Delhi for the Home Minister

Mr. Chidambram,

You say there shall be no re-visit of the Batla House encounter. You are of course absolutely right. All those agencies who conducted the encounter have already given themselves a clean chit. What further proof could be required of the genuineness of the encounter than the fact that no less than Karnail Singh, Joint Commissioner of Police, Special Cell, Delhi, (who by the by, was also trying to derail the probe into Ishrat Jahan encounter) wrote to the Lt Governor and the NHRC vouching for the innocence of their gallant heroes. Speaking of gallant heroes, we are sure it has been brought to your notice—or maybe it hasn’t—that some of the brave hearts of the Delhi Police Special Cell have been indicted by the courts in the past couple of years for scripting and executing fake encounters. These are the very men whom you have been felicitating with gallantry awards and Presidents’ medals. But Sir, rest assured, we are not asking what sort of democracies fete and glorify killers. JTSA welcomes the SIT report on Ishrat Jahan, demands free and fair probe into Batla House ‘Encounter’

JTSA welcomes the SIT report which has concluded that the teenaged college girl Ishrat Jahan and her three companions were killed in cold blood—and were not terrorists on way to kill Narendra Modi. This has reinforced the findings of the Tamang Enquiry Report which had drawn similar conclusions in 2009, and which the Gujarat government had tried to suppress and discredit.  The SIT report has given credence to the allegation of civil rights activists that the officers in Gujarat police had executed several people through the last decade in collusion with the highest political authority in the state. The police officers gained medals and promotions and Modi built his image as the Hindutva hero by highlighting the alleged assassination attempts on him. Swami & Friends: JTSA’s response to Praveen Swami

The story so far…

Jamia Teachers Solidarity Association was  formed after the so-called “encounter” at Batla House in 2008, in which two students of Jamia Millia Islamia were killed. You may remember posts on kafila at the time, questioning the credibility of police accounts of the “encounter” and criticizing the unethical nature of media coverage:

In April this year, JTSA, which has been demanding an independent probe into the encounter, issued a statement after the post mortem reports of Atif Ameen and Md. Sajid were made public, revealing that the two boys were not  killed in cross fire as Delhi Police claimed:

On April 25, 2010, Countercurrents published another statement by JTSA, titled Praveen Swami’s Not so Fabulous Fables, which began thus:

“If there is one infallible indicator of what the top Indian Intelligence agencies are thinking or cooking up, it is this: Praveen Swami’s articles. Each time the security establishment wishes to push a certain angle to this bomb blast or that, Swami’s articles appear magically, faithfully reflecting the Intelligence reports. After the Batla House ‘encounter’, he launched a tirade against all those who were questioning the police account of the shootout labeling them all ‘Alices in wonderland’. He went so far as to identify ‘precisely’ how Inspector Sharma was shot by claiming that “abdomen wound was inflicted with [Atif] Amin’s weapon and the shoulder hit, by Mohammad Sajid”.

And no sir, Swami’s conclusion was not based on post mortem reports of the killed, fire arm examination report or ballistic report but on this innocent fact: “the investigators believe that…” He certainly brings in a whole new meaning to ‘investigative journalism’. Swami however felt no need to pen an article when the postmortem reports of Atif and Sajid revealed that they had been shot from close range and that neither of them sustained gunshot wounds in the frontal region of the body—an impossibility in the case of a genuine encounter. Was it because the police and the Home Ministry chose to remain quiet after the revelations—hoping that the storm would quietly blow over?“
Praveen Swami wrote an injured response via a letter to Annie Zaidi, which too was published on Countercurrents.

Days after the startling revelation of the post mortem reports of Atif Ameen and Md. Sajid, which conclusively nailed the lie of the Delhi Police claims that the two boys were killed in cross fire, the security establishment has swung into damage control to ensure that no further information is made public. It is to be recalled that the post mortem reports could be made public only through the persistent efforts of RTI activist and Jamia student, Afroze Alam Sahil and the resolute resistance offered by the teachers and students of Jamia as well as other civil rights activists.
