CBI Mis-reporting on Search: Teesta Setalvad
We reproduce below the full statement (partially reported in the newspapers) from Teesta Setalvad on the CBI search at her office premises regarding the continuous misreporting that was going on during the search:
As I write this, the search is still not concluded. It is shocking that while over a dozen members of the CBI are still in our premises conducting the search, Delhi spokesperson is misleading the public and our vast supporters by a series of misinformations and official tweets.
In our view, and we repeat no laws have been broken by us. This is a continuation of the persecution and witchhunt first launched by the Gujarat police in 2014 then under the dispensation that rules Delhi. The CBI has taken the same documents that we had voluntarily on inspection given the MHA (FCRA dept). Over 25,000 pages of documentary evidence has been given to the Gujarat Police. When they could not succeed with the bizarre and desperate attempts to gain custody (February 2015), it was the Gujarat Government Home Department that wrote to the MHA and the current round of the persecutions began.
Its is shameful political vendetta. The Zakia Jafri case begins its final hearings on July 27 2015. The Naroda Patiya appeals (Kodnani and Bajrangi) are being heard in the Gujarat High Court tomorrow. Why the Law may still Catch Up with Amit Shah: Warisha Farasat

Amit Shah seems to be on a roll this election season. First, he escaped any punishment after delivering one of the most disturbing hate speeches made during the 2014 election campaign. After the Muzaffarnagar riots, attempts were made by political parties to capitalize on the suffering of the locals, and provoke certain communities to vote for them. And when Amit Shah was censured by the Election Commission for indulging in objectionable speeches during the election campaign in Uttar Pradesh, BJP Primeminsterial candidate Narendra Modi came to the defence of his most loyal lieutenant. Clearly, Amit Shah’s statement was made with the intention of polarizing the voters in a politically surcharged environment in Uttar Pradesh and amounted to hate speech. However, the Election Commission soon did a u-turn, diluted its own stand, withdrew the ban against Shah and allowed him to go ahead with his campaign. The withdrawal of ban against Amit Shah ignoring the drastic implications of his hate speech during the campaign was alarming.
And now, the CBI has not named Shah as an accused in the Ishrat Jehan fake encounter case stating that there is no ‘prosecutable evidence’ available against him. But Shah and his supporters should not think that this so-called ‘clean chit’ absolves him of all criminal responsibility for indulging in fake encounters in Gujarat. If we believe the CBI in the Ishrat Jehan case when they claim that there is no prosecutable evidence against Shah, consequently, we also need to trust their investigations in atleast two other fake encounters, namely the Sohrabuddin Shiekh and the Tulsiram Prajapati cases where the CBI have named Shah as an accused. Shah is presently being tried in these cases and is able to campaign during these elections only because he is out on bail.

इशरत जहाँ एक उन्नीस साल की लड़की थी जब वह मारी गई.शायद उसके बारे में इसके अलावा इस निश्चितता के साथ हम कुछ और कभी नहीं जान पाएंगे. इसकी वजह सिर्फ यह है कि जिन्हें इस देश में सच का पता लगाने का काम दिया गया है वे एक लंबे अरसे से झूठ को सच की तरह पेश करने का आसान रास्ता चुनने के आदी हो गए हैं. उनके इस मिथ्याचार पर कभी सवाल न खड़ा किया जा सके इसका सबसे अच्छा तरीका है राष्ट्र रक्षक की अपनी छवि का दुरुपयोग निस्संकोच करना. जो राष्ट्र की रक्षा करता है उसे उसकी रक्षा के लिए किसी को मात्र संदेह के आधार पर मार डालने का हक है, यह हमारे देश का सहज बोध है. सिर्फ अशिक्षितों का नहीं, उसने कहीं ज़्यादा राजनीति शास्त्र की किताबों से नागरिक अधिकारों का ज्ञान प्राप्त किए हुए स्नातकों का. उन सबका जिन्हें देश की जनता के पैसे से संविधान की हिफ़ाजत के लिए अलग-अलग काम सौंपे जाते हैं. और भी साफ़ कर लें, इन स्नातकों में भी उनका जो प्रशासनिक और पुलिस अधिकारी हैं, जासूसी के अलग-अलग महकमों से जुड़े ऑफिसर हैं, जिनकी असली पहचान कभी उजागर नहीं हो पाती. अगर दूसरे मुल्क में वे पकड़े जाएं तो वही देश उनसे हाथ धो लेता है जिसकी सुरक्षा में वे अपनी असली पहचान छिपाए फिरते हैं.
क्या कोई यह कहने की हिमाकत कर सकता है कि राष्ट्र-राज्य के खिलाफ साजिशें नहीं होतीं, कि राष्ट्र-विरोधी शक्तियों का अस्तित्व ही नहीं! यह बिलकुल अलग बात है कि राष्ट्र विरोधी का बिल्ला किन पर आसानी चस्पां किया जा सकता है और किन पर वह बिलकुल चिपकता ही नहीं. मसलन, इस्लामी राष्ट्र का तस्सवुर धर्मनिरपेक्ष भारतीय राष्ट्र के बिलकुल खिलाफ है, क्या इसके लिए किसी अतिरिक्त व्याख्या की आवश्यकता है? लेकिन यह समझना और समझाना टेढ़ी खीर है कि हिन्दू राष्ट्र की कल्पना भी उतनी ही राष्ट्रविरोधी है! आज से बीस साल पहले और आज भी खालिस्तान का ख़याल इस्लामी राष्ट्र जितना ही राष्ट्र विरोधी माना जाता था. Ishrat Jahan, Narendra Modi and the IB: How Not to be Non-Non Terrorist
The CBI charge-sheet in the Ishrat Jahan encounter case and its aftermath has led the BJP and supporters of Narendra Modi (within and without the Intelligence Bureau) to discover the joys of time travel. Apparently, David Coleman Headley’s testimony in 2010 (which says that Ishrat Jahan was an LeT operative) has given the Gujarat police officials a means to tell us why they killed Ishrat Jahan in 2004. Or, following on from Shivam Vij’s recent tweets, we could say: “The IB says that Headley says that Ishrat Jahan was a non-non terrorist…”
We will discuss more about this heady Headley testimony and ‘non-non terrorism’ later, but for now, let us admit that the secret of how a statement in the future can influence the unfolding an event six years in the past is known only to those who are partisan to Mr. Modi and his party. It is not for nothing that they call him a Yug Purush (‘The Man of Time’)- all times, past, present and future, can do his bidding, or so thinks the BJP. Media Campaign and the Ishrat Jahan Case: Faraz Ahmad
Guest post by FARAZ AHMAD: Even after the Central Bureau of Investigations (CBI) presented of its charge-sheet in CBI special court in Ahmedabad on July 3 in the infamous Ishrat Jahan encounter case of Gujarat of 2004 charging the Gujarat police, together with the IB of faking the encounter with Ishrat and three others, the media campaign, more particularly of the Times of India to damage CBI’s credibility continued unabated, with Bharti Jain’s lament on behalf of the IB.
However it is obvious that Bharti Jain’s is neither the first nor the last spirited defence of the questionable activities of our security and intelligence officers committing all kinds of crimes under the cover of protecting the nation from supposed external and internal threat. Unmindful of this, the media campaign is so visibly influenced by the BJP, attempting to discredit the CBI investigations and label these as biased before these are examined by the rightful authority, the courts, guided by competent lawyers of both the prosecution as well as Defence. Media manipulation on Ishrat continues: Vrinda Grover’s Protest Letter to Hindustan Times

On the day the CBI is set to file its chargesheet in the Ishrat Jahan fake encounter case, Hindustan Times has chosen to report about it in a manner that is malicious, prejudicial and intended to manipulate public opinion. The report, “ ‘Ishrat Jahan had links with Kashmir Separatists’: CBI” by Mahesh Langa and Abhishek Sharan in the Delhi/ Ahmedabad edition of the newspaper is nothing short of defamatory. The headline attributes this ‘information’ to the CBI whereas in the text of the report, it is said that two of those killed along with Ishrat “were associated with secessionist groups in Kashmir”. Clearly, the CBI is not saying that Ishrat had any links with any group. This is a deliberate misrepresentation and a cheap trick to make connections where none exist in order to tarnish the reputation of a deceased girl who is no longer present to defend herself. ‘Who Killed my daughter Ishrat Jehan ?’ – Statement by Shamima Kauser mother of deceased Ishrat Jehan

My daughter Ishrat Jehan was abducted, illegally confined and killed in cold blood by officers and men of the Gujarat police, in June 2004. She was killed as part of a larger conspiracy which had a political agenda. Ishrat’s murder was projected as an ‘encounter’ and justified by branding her a terrorist who had come with 3 other men to attack the Gujarat Chief Minister Narendra Modi. This was not the first fake encounter in Gujarat, other Muslims too had been executed in similar staged encounters, committed in the name of protecting the Chief Minster of Gujarat. Some of these other fake encounters, which are nothing but pre meditated extra judicial killings, are already under investigation and prosecution. IWIJ Report on Shopian
After months of uncertainty in which the entire political and state machinery has been galvanized to ensure that the perpetrators of the horrific rape and murder of two young women in Shopian go scot free, the Central Bureau of Investigation has produced a report that gives a clean chit to the indicted policemen and claims that the two women drowned in a stream. Below we carry a report by the Independent Women’s Initiative for Justice. Do circulate as widely as possible.
The IWIJ comprising of Uma Chakravarti, Usha Ramanathan, Vrinda Grover, Anuradha Bhasin Jamwal, Seema Misra and Dr. Ajita – are conducting a case watch on the Shopian rape and murder of 2 women in May 2009. The first case watch report was released by IWIJ on 10 December 2009, at New Delhi.

There are times when our critical antennae do not perk up. We do not wish to decode certain signs because we are all implicated in them. Following the 14 September blasts in Delhi, suddenly the media found a new value in ragpickers, street vendors, auto drivers and others who live on the fringes of the city and are generally looked down upon by people who inhabit apartments, blogs, cars (and autos, I must add).
Suddenly, by 15 September, ragpicker Krishna was canonized as a ‘hero’ by the media, the police and the state (the Delhi government claims credit for saving some lives with its ‘eyes and ears’ policy).
