A STATEMENT BY 133 ORGANIZATIONS and 858 INDIVIDUALS

Dear friends,

At the age of 18, we can vote for our councilors, MLAs, MPs. At 18, we decide who will make and implement policies that affect us, our loved ones, our community, our country. At 18, we are supposed to be mature enough to responsibly exercise our voting rights.

However, whether at the age of 18 or at the age of 50, we are not allowed to decide our romantic partners or who to marry. We are not allowed to have friendships and romantic relationships with people of `the other’ religion, caste, ethnicity, genders, sexualities.

If a Hindu woman chooses a Muslim man as her romantic partner, it is considered a crime in society and if they marry and the woman converts to Muslim religion, it is assumed that the Muslim man has forced her for conversion. In inter-faith and also in inter-caste marriages, it is taken for granted that the other person is bound to cheat you or dupe you and that the person you have chosen to be your partner has some wicked, ulterior motive to `make’ you fall in love.

In homo-erotic romantic relationships, often we hear how lesbian couples are being tortured by biological family, community and the police often acting on behalf of the family. Lesbian women, gay men, trans persons face severe repression at home for transgressing gender norms, aspiring for intimate and social lives beyond the compulsory Brahmanical hetero-normative family system. Many of us have similar painful and traumatic experiences.

`The Uttar Pradesh Prohibition of Unlawful Conversion of Religion Ordinance 2020’ passed on 27th November 2020, seeks to sanction the violence committed by family-religion-communities on people who transgress boundaries of religion, caste, gender and sexuality in choosing romantic partners.

This Ordinance is simultaneously an attack on any person who wishes to change her religion. According to the Act, every conversion is illegal. The conversion requires the prior sanction from the District Magistrate. The Ordinance also says that `reconversion’ to a person’s previous religion is not illegal even if done forcibly. This is the gateway to what is termed `ghar wapasi’.

Over the last few years, the Hindu right-wing groups and right-wing led governments have accelerated their attempts at whipping up paranoia about inter-faith romantic relationships. They deliberately call it ‘love-jihad’, equating the Muslim lover with terrorism, while there have been no incidence or statistics that even the right-wing gangs or governments have been able to furnish. The Gates of Vaikuntam?

When Hadiya Shafin shouted to the crowd that she converted voluntarily, that Shafin was her chosen husband, and that she wished to spend her life with him, some leading rationalist liberal feminists in Kerala sniggered at her: be grateful for the Indian Constitution which allows you to make a choice. This statement hid a despicable insult to her choice of Islam, slyly implying that it would not permit her any choices.

Goodness knows where these puerile, vain, indurate minds live their everyday lives.  Maybe they are either still able to insulate themselves somehow from the onslaught of Hindutva violence, or find it useful to use the arms of this Hindutva hegemonised thuggish state to their narrow, shamefully narrow, ends.

Whatever, I could see no trace of the protective presence of the Indian Constitution when the Supreme Court heard Hadiya. I could see not the highest court of Justice of a vibrant democracy but I got a sense of how the Gates of Celestial Vaikuntam may look like:

Free Hadiya March on 3 Oct: Citizens for Hadiya

On October 3, students, human rights activists, muslim-dalit-adivasi-bahujan organisations from all over India are converging in Thiruvananthapuram to march for the freedom of the twenty-four-year-old Hadiya, who is under virtual house arrest in the home of her father, Mr Asokan after the shocking annulment of her marriage to her chosen partner by the Kerala HC. The march will begin from the Martyr’s Column, Palayam, at 11 AM and end at the Kerala State Government Secretariat junction. Through this we hope to draw the attention of the public to the grave dangers posed by these decisions of the judiciary and by the shameful silence and criminal inaction of the Kerala government , which claims leftist and secular credentials. We invite all to participate in this march and strengthen the hands of those who are fighting to undo this unspeakable violation of justice to an Indian citizen and the gross attack on the fundamentals of Indian democracy. Your Lordship,

We write to you, to bring to your notice a recent judgement of the Kerala High Court which has annulled a consensual marriage of an adult Muslim woman. The judgement also makes many other remarks which can completely undermine any claim for equal citizenship for women and are violative of their fundamental and constitutional rights. Hadiya is a young woman, 24 years of age who has went on record to say that she willingly converted to Islam. Her parents have since approached the court twice asserting that she has converted to Islam under external force, demanding that she return to living with them. In their second petition to the Kerala High Court they also raised the allegation that she would be transported outside the country and demanded the court’s intervention.

During the proceedings of the second petition, Hadiya contracted a marriage with a Muslim man according to Islamic rites and rituals and stated her full consent in the marriage. The Kerala High Court has finally annulled the marriage and forced Hadiya into the custody of her father. She has not even been allowed a phone and has been denied any contact with the rest of the world beside her parents, in effect putting her under house arrest for no proven crime committed by her. Policemen guard her every day and just beyond stand RSS cadre further ensuring that their prize catch finds no exit from the situation.

Love for Fawad Khan vs Jihad against Love: Charu Gupta

Fawad Khan, a Pakistani Muslim male, has become an endearing and enduring metaphor, a fascinating icon, the new heartthrob and fantasy of Indian girls and women. Zindagi, an Indian entertainment television channel, launched just four months ago, which telecasts cross-border serials from Pakistan, has captured our imagination. The central idiom of the channel has proven to be Fawad Khan, who besides having looks to die for and undeniable charm, portrays a sensitive, emotional and mature lover and husband in top of the charts serials Zindagi Gulzar Hai and Humsafar. He has entered Bollywood through the film Khubsoorat. Fan mails from women have poured over websites. One of them says: ‘You have to be living under a rock if you have not heard of Fawad Khan yet…. Did your mother just tell you she has a crush on Fawad Khan? Your female colleagues are probably head-over-heels in love with him too…. Women maybe have more photos of Fawad Khan in their phones than their own.’ Describing the film Khubsoorat, Shobha De articulates: ‘So, who is the real “khubsoorat” in the movie….Any guesses? You’ve got it! It’s a slim, bearded bloke from across the border…. He’s as yummy as those irresistible Lahori kebabs, and desi ladies want him.’

Fawad Khan’s religious and national identity is not hidden or muted; it is explicit and out there. But Indian women, most of them Hindu, are totally disinterested or unconcerned with the fact. While the ‘love jihad’ hysterics are crying themselves hoarse, Indian girls are not giving a damn whether Fawad Khan is a Muslim or a Pakistani. Instead, they are dreaming of having someone like him in their lives to romance and to love, who can make them feel so very special. This swooning over Fawad Khan by Indian girls and women of all ages reveals a religious and national liminality that can stump the hysteria over the constructed bogey of love jihad. The representation of Fawad Khan and the construction of love jihad, both in very different ways are part of fictive imaginations, myths and rhetoric, spectacles and obsessions. At the same time, they undercut each other, reflecting women’s desires on the one hand and Hindu male fears on the other. Love for Fawad Khan personifies allegories of intimacy and romance, while the love jihad campaign embodies hatred and anxieties. One contests power, the other attempts to reinstate it. The ‘new and improved’ Love Jihad formula, unethical media and ‘social science’ votaries

Caught on the back foot by the humiliating backfiring of their fantastical Meerut scenario of ‘gangrape and forcible conversion’, in which the role of the BJP as well as of sundry Hindutvavaadi organizations in breaking up a consensual Hindu-Muslim relationship have been thoroughly exposed, the Hindu Right appears to have arrived at a new formula. This formula has made its appearance in several spaces – in comments on Kafila (some of which have been passed, many more deleted; mostly pseudonymous or anonymous, and in varying degrees of abusiveness); on the social media and in personal blogs; and more respectably, in newspapers, in signed op-eds and articles, the most recent of them by the perennially amusing Madhu Kishwar.

The formula is patented across these sites and involves all or several of the following claims:

a) Hindutvavaadi groups are not the only ones to fear ‘Love Jihad’ – the Church in Kerala and the Akal Takht have also expressed their anxieties about this campaign. So there must be some fire generating all the smoke.

b) So real is the danger that the claims have been investigated by the police, as directed to do so by courts.

c) Hindutvavaadi groups have no objection to inter-faith marriage, what they object to is the cheating of Hindu women into marriage in a well orchestrated campaign by Muslim men who trap them in polygamous marriages only to convert them and produce several children, thus raising the Muslim population.

d) What is happening in India is only a small part of the Global Islamic Terror Machine’s global campaign to use non-Muslim women as sex slaves, to prostitute them, or to seduce them in order to convert them. The recent exposure of a pedophile ring in the UK run by Pakistani men is treated as proof of the existence of such a globally coordinated campaign in which all Muslims are suspect – from Al-Baghdadi of ISIS to your classmate.

e) As irrefutable proofs, three links are generally circulated: a) a programme of IBN7 that ‘exposes Love Jihad’, and b) two videos of young women who supposedly speak about being victims of Love Jihad.

Madhu Kishwar in her article asserts all of these claims produced by the RSS Myth Machine, although she is probably not yet aware of the last item – which I will address at length in conclusion. Love Jihad and the roots of hate: John Dayal

Three parallel strands of India’s cultural history have merged in recent times into a lethal phenomenon that has been termed “Love Jihad”, which has not only obtruded into the personal lives of young men and women of Hindu, Muslim, Sikh and Christian religious communities, but has put to grave risk individual security and community peace.

A attitude to Muslims that verges on Islamaphobia, a pathological hatred for conversions to Christianity – both seen as disturbing the demographic equation in India to  overwhelm the Hindu majority take the traditional national culture of feudalism and patriarchy to a new and explosive level. The current crisis in the Middle east and on the borders with Pakistan in Jammu and Kashmir provide the trigger, as it were, to the short fuse.

The Indo-Gangetic plans of North India are the main sites of this confrontation but its repercussions have been seen deep in the states of southern India, and the Indian and south Asian diaspora in the United Kingdom and the United states of America.

Political encouragement and patronage to lumpen and criminal moral vigilante groups, administrative and police impunity have led to targetted violence, a wave of hate campaigns, a polarized landscape, and deeply traumatised young couples who have dared, and sometimes married across religious borders. The media has taken sides, the Hindi language newspapers and  television news channels  exhibiting majoritarian bigotry. Civil society has found itself outnumbered.

The church, willy nilly, has found itself dragged into this unsavoury situation. Senior  episcopal and lay leadership of both Catholic and  protestant  denominations have so far not been audible in the defence of what, at the end of the day, are issues of human rights guaranteed under the Indian Constitution  and the Charter of the United Nations.

‘The Meerut Girl’, desperate Hindutvavaadis and their Jihad against Love

The phrase ‘Jihad Against Love’ is Janaki Nair’s in The Hindu – Why Love is a Four Letter Word. I can’t think of a better description of this sick, twisted, violent campaign, in which local Hindutvavaadi thugs ally with families desperate to control their young sons and daughters from – quite simply – falling in love. Families that have no qualms in violently separating their children from relationships outside their caste or religious community, often killing one or both of them. Such murders have come to be dubbed ‘honour killings’ by the English media, but a starker, more revealing term is suggested by Pratiksha Baxi – ‘custodial deaths’. Indeed, the young people killed in such cases are in the custody, much like prisoners, of their own families.

If you haven’t had enough of tragic love stories, take a look at Perveez Mody’s book, The Intimate State: Love-Marriage and the Law in Delhi (Routledge, Oxford and New Delhi, 2008) for  heart-breaking accounts of of treachery and betrayal by parents, of their own children who fall in love with the wrong people, and the kinds of physical violence unleashed on rebellious couples by their own families.

The Hindutvavaadi campaign has an able ally in the Christian Right. A report in 2009 in The Times of India said:

‘Love Jihad’, a religious conversion racket which lures gullible girls by feigning love, has brought rivals Vishwa Hindu Parishad and Christian groups in Kerala together.

“Both Hindu and Christian girls are falling prey to the design. So we are cooperating with the VHP on tackling this. We will work together to whatever extent possible,” said K S Samson, an office-bearer of Kochi-based Christian Association for Social Action (CASA), a voluntary Christian association.

Samson said some days ago, CASA got to know about a Hindu family in a Christian parish where a school going girl was the victim. ”We immediately referred it to the VHP,” he said, adding the saffron outfit has helped them in many cases.

Since the past one year, especially after the parliamentary elections were looming close, extremist RSS elements have become all the more aggressive all over the country, especially in the north, east and west. They have taken pains to circulate false news stories about Muslims in general, and Muslim youth in particular, as somehow prone to violence ,and conniving to entrap Hindu girls in romantic relationships with the sole object of securing their conversion to Islam. Regional vernacular newspapers have carried fabricated stories about Muslim youth turning to terrorism and planning bomb blasts in many Indian cities.

( I had spent a week in Gujarat in February-March,2007 and published two reports in TEHELKA. Reproducing the first part to remind myself that it was again in  Gujarat where  the fear of ‘Love Jihad’ was invented in its present incarnation.)

For many Gujaratis, Narendra Modi is a man who provides material and spiritual comforts to his people.Gujarat is calm. And is on the march. Every village of the state is a jyotigram. Narmada water is flowing in abundance in the canals quenching the thirst of Gujaratis. “Was not Surat flooded a few months back and did not the people of Gujarat suffer?” I ask my driver. “No, was not Narendrabhai there to take care of everything?”, he replies. How can anything go wrong when Narendrabhai is keeping watch!

Narendra Modi, you see, does not have a family and he works round the clock, we are informed. I find Modi smiling down at us benevolently from the digital billboards that dot Ahmedabad. There is no escaping his firm developmental smile. “The man has impressive qualities. Gujarat is bound to forge ahead under this workaholic chief minister.
