Aligarh Muslim University women should not back down just because BJP has taken up their cause: Asiya Islam

ASIYA ISLAM argues on Scroll.in that AMU’s women students demanding library access have always been warned not to wash the institution’s dirty linen in public, for fear of providing fodder for Hindutva forces.

Things must have changed since I studied at Aligarh Muslim University for three years until 2009. This week, the vice chancellor of the university, Lieutenant General (retd) Zameeruddin Shah, justified the policy of not allowing undergraduate women to use the main Maulana Azad Library. If more women are allowed, the vice chancellor said, the number of men in the library would swell by at least four times. Somehow, I just do not remember hordes of studious men at AMU.

It is worth noting that the vice chancellor has only upheld a ban that has always existed and articulated his reasons for doing so. The issue is not new. It just seems to surface periodically – the media gets interested, makes a bit of noise, after some time it all dies down, and sadly nothing changes…

In this current political climate, we need to realise that inequalities are multifarious. But demands for gender equality do not compete with other social justice issues at hand – rather, they are complementary. We cannot excuse continued discrimination against women while asking for minority rights. Therefore, we should question the government’s and media’s sudden concern with gender equality in AMU (this is after all a deeply conservative government), but let us not discount the gravity of the library issue for women who study and work there.

Crime and Consent: Vrinda Grover

VRINDA GROVER analyses the recent Delhi High Court judgement on the rape and consequent death of a 65 year old woman, acquitting the accused because the woman was ‘menopausal’ and making a curious distinction between ‘forceful’  and ‘forcible’ intercourse.

In a recent judgment in Achey Lal vs State Govt of NCT Delhi, the Delhi High Court on October 30 set aside the conviction of the appellant for rape and murder. What has provoked discussion are the observations, inferences and conclusions of the court. Briefly, the facts as reported in the judgment are: on December 31 2010, a house maid, aged about 65-70 years, was found dead, with her clothes disheveled to expose her body. The accused, Achey Lal, 45 years old, was present in the room in an intoxicated condition. The husband of the deceased deposed that the accused had come at 8 am that day to his house with a quarter bottle of alcohol and when it finished, the husband left, while the accused stayed on with his deceased wife. The cause of death, according to the doctor who conducted the post mortem, “was asphyxia due to aspiration of gastric contents consequent upon forceful sexual intercourse, which was sufficient to cause death in the ordinary course of nature”.

Statement On Sterilsation deaths in Chattisgarh by Public Health groups

The Jan Swasthya Abhiyan, Sama Resource Group for Women and Health, Commonhealth and National Alliance for Maternal Health and Human Rights are shocked at the death of 11 women and the critical condition of 50 other women due to the callous negligence of the Health Department, Government of Chhattisgarh. The deaths and morbidities are a result of a botched-up sterilization operation camp organized by a private hospital under the National Family Planning Programme in Takhatpur Block of Bilaspur District on 8 November 2014. Horrifically, during this camp, 83 women were subject to surgeries in a short span of 5 to 6 hours. Amongst those who have died are Dalits, tribals and Other Backward Classes, leaving behind shattered families and young children. This has resulted in gross violation of the reproductive and health rights of the women.

This tragedy raises grave questions about the unsafe, unhygienic conditions and the slipshod attitude under which these operations were conducted. Moreover, the women who are presently critical continue to get treatment in dismal conditions exposing them to further risks and danger.The surgeries were conducted in complete violation of the Supreme Court orders (Ramakant Rai Vs Govt. of India, 2005 and Devika Biswas Vs Govt. of India, 2012). These orders instruct that a maximum of 30 operations can be conducted in a day with 2 separate laparoscopes only in government facilities. Also, one doctor cannot do more than 10 sterilizations in one day.  Despite this, the surgeon in Chhattisgarh performed about three times the permissible number of surgeries (83) in less than 6 hours in a private hospital which has reportedly remained closed for 15 years. This is evidence of how these operations were not done under standard protocols.

‘Kiss of Love’ in Delhi, confronting the RSS: Vasundhara Jairath and Bonojit Hussain

In the first of its kind in India, youth in Kochi launched a campaign called ‘Kiss of Love’ to challenge the moral policing of the Hindu Right. While that protest was attacked by right wing thugs and suppressed by the police, this form of protest has since spread to different parts of the country like Hyderabad, Bombay and Calcutta. Today, the ‘Kiss of Love’ protest was held at nowhere short of the Rashtriya Swayamsevak Sangh (RSS) head office in New Delhi. A few individuals took the initiative and gave a call for this protest on Facebook with the title, ‘Sanghi Gunde Hoshiyar, Tere Samne Karenge Pyaar’ (Sanghi thugs beware, we will love in front you). ‘Downtown’ – Where the Kiss of Love Began: Sudha K. F.

[This article was written in response to the recent incident of vandalism and violence meted out by BJP- affiliated Yuvamorcha activists against a restaurant called Downtown in Kozhikode, Kerala. This was the incident that led to the protest – the Kiss of Love at Kochi, Kiss of Love in Kolkata, and now, most audaciously outside the RSS Office in Jhandewalan. Wherever it goes, it acquires a flavour of its own. Thus in Kolkata, hokkolorob (let there be turmoil) mutated into another set of slogans – hokchumban (let there be kiss – or, let us kiss) and now, Sanghi gunde hoshiyar, tere saamne karenge pyar (beware Sangh goons, we will (make) love right before you. Sudha K. F. gives a sense of what it felt like after the goons attacked, the sense of indignation that subsequently burst forth.]

The now “notorious” Downtown restaurant is 5 minutes away by foot, from my home in my hometown Kozhikode. During my schooldays, that place was an old workshop. The restaurant came up after I had been away from my hometown for quite a while for my higher education. I remember being thrilled at the sight of this fine looking restaurant/coffee shop with glass windows, near my home during one of my visits. Earlier a few establishments had replaced the old workshop but didn’t do well commercially and closed down hastily. As I passed Downtown one evening, its busiest hour, my father remarked that this might have a longer life because it is so crowded with so many people frequenting the place for dinner. In late October, the youth wing of the Sangh Pariwar among others vandalised a café in Calicut on the pretext that lovers ‘date’ each another sitting in this café. When many young men and women in Kochi gathered together to protest by expressing their love in public, they got beaten up by various right wing groups and the police in response. The students and youths in different regions of the country gathered in solidarity of this protest going by the name of ‘Kiss of Love’. At the same time, as the news spread rapidly through the media and social networking site, a polarization continues to develop in the society, even among the individual activists and similar organizations, for and against the form of this movement.

Statement Condemning Rape on EFLU Campus: EFLU Alumni and Other Concerned Individuals

[ This is a statement prepared by some alumni of EFLU, in the aftermath of the rape of a woman student on campus last week. The statement was then shared on the social media for endorsement. Those who had drafter the statement say that they “…were overwhelmed by the support shown by a cross section of people including alumni, not just practicing academics and students of other universities, but also techies and bankers, journalists and professionals.” The statement is intended to be seen as an expression of solidarity with the complainant, in appreciation of her bravery and as a means of extending support to the EFLU community who are trying to fight for gender justice in innovative and inclusive ways. ]

This is a public statement condemning the rape of a girl student in the hostels of The English and Foreign Languages University, Hyderabad. We express our solidarity with the complainant and demand that the guilty be punished. Happening within the university space, this action by the student’s peers shocks and saddens us, but also points at the deep entrenchment of patriarchy even within the most radical of spaces.

Understanding the De- Criminalisation Demand: Aarthi Pai and Meena Saraswathi Seshu

STOP Panic around Sex Work; by conflating it with Trafficking

VAMP, SANGRAM and The National Network of Sex Workers, India (NNSW); a network of sex worker organisations, collectives, federations and unions from Karnataka, Tamil Nadu, Maharashtra, Kerala and Andhra Pradesh;  seek decriminalization of sex work. 

First, a quick distinction between ‘decriminalization’ and ‘legalization’.

Decriminalisation is the repeal or amendment of laws or statutes which make certain acts criminal, so that those acts are no longer crimes or offenses.

Legalisation, on the other hand, will mean regulation and control by the state authority ushering a zone specific ‘licence raj’ with mandatory health check-up, criminalizing defaulters. It could also mean criminalizing of some aspects of sex work e.g. clients.

The UNDP Global Commission on HIV and the Law stated that, “Sex work and sex trafficking are not the same. The difference is that the former is consensual whereas the latter coercive. Any point of view that casts “voluntary prostitution” as an oxymoron erases the dignity and autonomy of the sex worker in myriad ways. It turns self – directed actors into victims in need of rescue.”[1] Sex work is adult consensual provision of sexual services and must not be equated with sexual exploitation or sex trafficking. The ‘new and improved’ Love Jihad formula, unethical media and ‘social science’ votaries

Caught on the back foot by the humiliating backfiring of their fantastical Meerut scenario of ‘gangrape and forcible conversion’, in which the role of the BJP as well as of sundry Hindutvavaadi organizations in breaking up a consensual Hindu-Muslim relationship have been thoroughly exposed, the Hindu Right appears to have arrived at a new formula. This formula has made its appearance in several spaces – in comments on Kafila (some of which have been passed, many more deleted; mostly pseudonymous or anonymous, and in varying degrees of abusiveness); on the social media and in personal blogs; and more respectably, in newspapers, in signed op-eds and articles, the most recent of them by the perennially amusing Madhu Kishwar.

The formula is patented across these sites and involves all or several of the following claims:

a) Hindutvavaadi groups are not the only ones to fear ‘Love Jihad’ – the Church in Kerala and the Akal Takht have also expressed their anxieties about this campaign. So there must be some fire generating all the smoke.

b) So real is the danger that the claims have been investigated by the police, as directed to do so by courts.

c) Hindutvavaadi groups have no objection to inter-faith marriage, what they object to is the cheating of Hindu women into marriage in a well orchestrated campaign by Muslim men who trap them in polygamous marriages only to convert them and produce several children, thus raising the Muslim population.

d) What is happening in India is only a small part of the Global Islamic Terror Machine’s global campaign to use non-Muslim women as sex slaves, to prostitute them, or to seduce them in order to convert them. The recent exposure of a pedophile ring in the UK run by Pakistani men is treated as proof of the existence of such a globally coordinated campaign in which all Muslims are suspect – from Al-Baghdadi of ISIS to your classmate.

e) As irrefutable proofs, three links are generally circulated: a) a programme of IBN7 that ‘exposes Love Jihad’, and b) two videos of young women who supposedly speak about being victims of Love Jihad.

Madhu Kishwar in her article asserts all of these claims produced by the RSS Myth Machine, although she is probably not yet aware of the last item – which I will address at length in conclusion. A Reply to Ranabir Samaddar on Jadavpur: Uditi Sen

Prof. Ranabir Samaddar of the Calcutta Research Group has recently published a screed (in the DNA Newspaper) against the #Hokkolorob movement  initiated by the students of Jadavpur University which has found resonance with students and young people all over West Bengal and elsewhere in India. Samaddar, who seems to have lost the ability to recognize the many intersections of solidarity between students, young people in metropolitan as well as non-metropolitan contexts, women, young workers, accuses the movement of what he calls ‘elitism’ and a disconnect with realities on the ground.

It is settled then. With this latest denunciation (by Ranabir Samaddar, in DNA, see link above) of the student movement at Jadavpur, we finally have a verdict we can trust. Student politics is not what it used to be. The glory days of the 60s are long gone and the protesting young today fail to live up to the authentic radicalism of their elders. Those were the days, indeed. Those were the days when student politics, organised under the banner of the organised left took up real issues, such as those of the peasants and workers and did not distract themselves with inequities closer to home. Such as, why women ‘comrades’ were expected to cook and clean and provide for their men, who led the vanguard. Such as why even the most progressive politics, when speaking of the rights of peasants, meant the rights of male peasants. Those indeed were the days of glory, which we should remember and seek to emulate, when the leaders, usually dadas, had no answers when a peasant woman asked, ‘“Why should my comrade beat me at home?” (See Samita Sen’s Toward a Feminist Politics: The Indian Women’s Movement in Historical Perspective)

‘The Meerut Girl’, desperate Hindutvavaadis and their Jihad against Love

[With two updates added on October 15, 2014]

The phrase ‘Jihad Against Love’ is Janaki Nair’s in The HinduWhy Love is a Four Letter Word. I can’t think of a better description of this sick, twisted, violent campaign, in which local Hindutvavaadi thugs ally with families desperate to control their young sons and daughters from – quite simply – falling in love. Families that have no qualms in violently separating their children from relationships outside their caste or religious community, often killing one or both of them. Such murders have come to be dubbed ‘honour killings’ by the English media, but a starker, more revealing term is suggested by Pratiksha Baxi – ‘custodial deaths’. Indeed, the young people killed in such cases are in the custody, much like prisoners, of their own families.

If you haven’t had enough of tragic love stories, take a look at Perveez Mody’s book, The Intimate State: Love-Marriage and the Law in Delhi (Routledge, Oxford and New Delhi, 2008) for  heart-breaking accounts of of treachery and betrayal by parents, of their own children who fall in love with the wrong people, and the kinds of physical violence unleashed on rebellious couples by their own families.

The Hindutvavaadi campaign has an able ally in the Christian Right. A report in 2009 in The Times of India said:

‘Love Jihad’, a religious conversion racket which lures gullible girls by feigning love, has brought rivals Vishwa Hindu Parishad and Christian groups in Kerala together.

“Both Hindu and Christian girls are falling prey to the design. So we are cooperating with the VHP on tackling this. We will work together to whatever extent possible,” said K S Samson, an office-bearer of Kochi-based Christian Association for Social Action (CASA), a voluntary Christian association.

Samson said some days ago, CASA got to know about a Hindu family in a Christian parish where a school going girl was the victim. ”We immediately referred it to the VHP,” he said, adding the saffron outfit has helped them in many cases.

A Response to ‘Uniform Civil Code – the women’s movement perspective’: Rohini Hensman

Nivedita has done us all a service in kicking off a wider debate on personal laws than the ones which have been taking place within feminist groups. One of the most important points she makes is that we have correctly moved away from the demand for uniformity. Uniform laws need not be either gender-just or secular, which is what we are aiming for; indeed, patriarchal theocracies have extremely uniform family laws! She has also raised several other questions that need to be discussed. I look at some of them here in the hope of taking the debate forward.

Polygamy: Unless polyandry is also allowed, polygyny is not gender-just, and ought ot be opposed. The fact that the vast majority of Muslim women, who are directly affected by the existence of legally sanctioned polygamy, are opposed to it, makes this an obvious move for feminists. To support polygamy on the grounds that it offers more protection to second or third wives sounds like a perverse argument. If we accept it, we should also be demanding that polygamy be made legal in other personal laws! Second or third wives would surely be better protected by being able to sue their fake husbands for fraud and get hefty damages.

Contractualising all intimate relationships: Although legal recognition of stable non-marital relationships would be desirable, contractualising all intimate relationships may not be such a good idea. Uniform Civil Code – the women’s movement perspective

The BJP has once again raised the issue of a Uniform Civil Code (UCC) for all Indian citizens,  posed in a way that presents the BJP as ‘secular’ and pro-women, and opponents as communal or ‘pseudo-secular’ and anti-women. Since Independence, there has been very little change in the contours of the debate in the public domain, both within the BJP as well as among public intellectuals not necessarily aligned with the Hindu Right. The only change that has come about since the 1990s is that the UCC is now also posed as a ‘women’s rights’ issue and not only as a matter of national integrity, which requires the eradication of multiple legal systems. This new equation of ‘women’s rights’ with the UCC is at least partly a result of the interventions by the women’s movement in the debate in the 1990s. However, within BJP (and mainstream) discourse, it is assumed that only minority women need saving, for ‘we Hindus’ have already given ‘our’ women equal rights.

The women’s movement has developed this debate in complex and multiple directions over the decades, which this essay will briefly outline.

The debate over the UCC in contemporary India is produced by the tension between two notions of rights in the Fundamental Rights (Part III) of the constitution. The bearer of rights is both the individual citizen and the collectivity – the former is the subject of Articles 14 to 24 which ensure the individual’s rights to equality and freedom and the latter of Articles 25 to 30 which protect religious freedom and the educational and cultural rights of minorities [1]. It is from the latter that religious communities derive the right to be governed by their own ‘Personal Laws’. Since these Personal Laws cover matters of marriage, property inheritance and guardianship of children, and since all Personal Laws discriminate against women, the tension in Part III of the constitution can be read as a contradiction between the rights of women as individual citizens and those of religious communities as collective units of a democracy. Dear students of Jadavpur University (JU),

We, members of Jagriti, the Women’s Development Cell of Bharati College, University of Delhi, pledge our support to your struggle for gender justice and administrative and pedagogical accountability. We are deeply disturbed to receive news of administrative indifference to sexual harassment and of the consequent police brutality in JU campus. We unanimously and unequivocally condemn JU administration and the West Bengal police for ignoring students’ valid demands and for orchestrating violence onto students.

In iterating our support to you, we iterate also the belief that the entire administrative mechanism of JU failed to protect its own students. We hold the Vice-Chancellor (VC) and the Dean of Students responsible for not ensuring that the students’ demands were satisfactorily addressed; we also hold the Internal Complaints Committee responsible for letting what could have been only a campus-specific issue escalate into a major humanitarian and academic crisis. This incident is a lesson not just for JU but for educational institutions and workplaces globally to comprehensively commit themselves to gender justice and to accountability. University administrations are in anyway obliged to engage with their students in healthy and open dialogues on each and every issue that the students, persons whom the university is supposed to service, feel pertinent, and to do the complete opposite, to break down all communication and instead call armed police personnel to violently disperse students is totally unacceptable. JU has been known nationally as well as internationally as a hub of free and liberal thinking, and this shocking attempt to choke dissent out of it attracts our unstinting condemnation.

We support your demand for the non-extension of the tenure of Mr. Chakrabarti, the current interim VC. This issue is political, but it does not belong to any political party, and we commend your transcending political barriers in pursuance of your struggle against the JU administration. We commend your courage, strength and commitment to gender justice and to human rights, and offer our condolences for the losses which you have suffered these past few days. Through this note, we also appeal to the Governor of West Bengal to initiate a magisterial enquiry into the police brutality on JU campus, and have all officials, JU as well as police, who ordered this dismissed from service and tried in a court of law for gross dereliction of duty and for grievous injury to innocent lives.

Jagriti unanimously stands in solidarity with the complainant and the students of Jadavpur University.

About eight years ago, while lounging about doing nothing much in the campus of Jadavpur University where I was a student of the English department, I came across some callously etched graffiti:

Jodi prem na dile praane
Tobe Jadavpure pathanor ki mane?
(If you haven’t given this life some love–
What is the point of sending one to Jadavpur?)

Eight years on I cannot imagine the luxury of lounging about doing nothing much. One moves on in life after graduating from Jadavpur University. Meanwhile, in home and the world, the complete freedom (some will persist in calling this anarchy) of the JU campus has made it a legend somewhat like Dirty Harry: either worship and put it in on a pedestal, or condemn it thoroughly. The reputation of JU since the infamous 1970s has been as a hub of constantly bubbling anarchism, where Naxalites are hatching their next program of action, where ignorant armies like SFI and other anti-SFI groups clash by night.

Jadavpur University students struggle against gender violence

In Jadavpur University (a State aided university of West Bengal), the Arts Students Faculty Union organizes a students’ cultural festival, Sanskriti. On the second night of the festival, an incident of violence occurred in the campus that resulted in a chain of events.

On the night of 28th August, during the ongoing festival, a second year student from the Department of History, Jadavpur University, was allegedly molested inside campus premises by a group of people from the hostel, and her male friend (not a JU student), was beaten up. According to the victim, she had gone near the hostel to relieve herself given the unavailability of bathrooms at the time, accompanied by her friend. On their way back, a group of hostel boys allegedly passed snide remarks which led to a scuffle, and then escalated to something bigger. While her friend was allegedly pulled away and beaten up, she was dragged into the hostel, where she claims she was molested. So Onam is here again — despite the fact that several contradictory stars above  now form a malefic conjunction in the fate of poor Malayalis in Kerala. Indeed, rarely has a stranger gang dominated the starry heavens of our destiny: V M Sudheeran’s targeted gullet moralism that promises to close down a very large number of bars in Kerala and pave the way for total prohibition in the future, gangs of Hindu right wing youth and women forcing the government’s liquor outlets to close, policemen puffed up with jingoistic nationalism who hallucinate about Maoists in wake and sleep and declare social activists like Ajitha “dead”, CPM offspring who think that making foul, putrid public statements justifying murder is politics. All these are, well, rather drunk on self-righteousness and to be true, present a slightly ridiculous sight. Even the weather looks ridiculously inebriated – the sky alternates between bright sunny spells and horrid, harsh showers, crazily swinging between sunny smiles and bursts of tears. Rape and Rakhi – Patriarchal-Communal Narratives: Kavita Krishnan

Even as the communal cauldron in UP is kept on the boil, there is news that the RSS has launched a campaign to tie Rakhis to lakhs of Hindu men, asking them to pledge to protect their sisters from Muslim men and “love jehad.” The VHP has been running a helpline urging Hindus to approach them “if your daughter is being harassed by Muslim boys.” And a khap panchayat in Muzaffarnagar has imposed a ban on mobile phones and jeans for girls, claiming that these result in ‘eve-teasing’.

Woven into the above events is an old, familiar theme – that of patriarchal restrictions packaged as ‘protection’. In the wake of the anti-rape movement that followed December 16 2012, the streets of Delhi and many other parts of India had resounded with the voices of women declaring ‘Don’t take away our freedoms in the name of ‘protection’ – protect our right to fearless, fullest freedom instead’. Women Have Been Branded Liars!

The recent Supreme Court judgment in the case of Arnesh Kumar v. State of Bihar & Anr. (Criminal Appeal No. 1277 of 2014) has once again brought to light the concern shared by the larger society about the ‘misuse’ of Section 498-A of the Indian Penal Code (hereinafter “IPC”) and the Dowry Prohibition Act, 1961. This concern has been raised many times in the past (and present) and the judiciary has gone to the length of labeling this ‘misuse’, especially that of Section 498-A, IPC,  ‘legal terrorism’ (in Sushil Kumar Sharma v. Union of India JT 2005 (6) SC 266.)

However, what has changed this time is that through this judgment the Supreme Court has endorsed and legitimized the common stereotype that women exaggerate and fabricate stories of violence to seek vengeance against their husbands and matrimonial families.
