Nivedita Menon ends her commentary on the unfolding Tehelka sexual assault case in Kafila by asserting – “the time has come. It is now”. It should be, but is it? Are we witnessing the end game of an old Indian patriarchal sport called sexual assault? The sport is akin to another old game called the royal hunt that was an important part of elite political culture of South Asia. The rules of the sport were then as now heavily loaded in favour of the royal huntsman – weapons, support teams, timing, everything required for the thrill of a kill were with powerful men out to conquer. The expeditions however were not just about the kill. The sport was also a means of asserting authority over tracts of the wild and those that lived there and were by some misfortune not aware of prevailing authority structures. The royal hunt was an event to showcase to subjects the might, prowess and authority of the elite rulers. It was the stamping of power over human as well as animal kingdom. The royal huntsman could not but win. He could not but kill.

Meet Tarun Tejpal’s spin doctors

Unlike Justice (Retd.) Ashok Kumar Ganguly, Tarun Tejpal’s defenders cannot cry innocence given that Tejpal has confessed to his crime, albeit disputing the degree of it. He has even confessed having told his colleague that suffering the sexual assault was the “easiest way of keeping your job”. Even his two decades old comrade Shoma Choudhury is unable to defend him beyond saying that he has his versions. Nobody buys Tejpal’s ludicrous retractions.

This put Tejpal’s friends, fellow molesters and self-defeating secularists in a bind. Many of his friends have chosen silence, which is understandable. It is only human to recuse oneself from the difficult choice between principle and friendship. Though some like Arundhati Roy and Sankarshan Thakur have admirably chosen principle over personal association. But those who wanted to come out and actually defend Tejpal were at a loss for words. How do they defend a crime whose perpetrator has confessed to it? So they came up with a few sly defences which pretend to be nuances. Some like BG Verghese are writing as though they were ghostwriting Shoma Choudhury’s defence.

So let us lacerate these defences one by one.

The PUCL
  • Expresses Solidarity with the struggle of the Tehelka Journalist who raised her voice against Rape and Intimidation by the Ex-Editor Tarun Tejpal.
  • Demands fair investigation and early charge sheet into the matter, from the Goa Police.
  • Considers Six Day of Custodial interrogation of Tarun Tejpal granted by the Goa Judicial Magistrate Court unnecessary and invidious.
  • Appeals that police custody and the case not become a tool in the hands of BJP administered Goa police to settle scores with Tejpal.
The People’s Union for Civil Liberties from the very beginning has supported the complaint of the woman journalist of Tehelka magazine who accused the editor of Tehelka, Tarun Tejpal, of rape and sexual assault. PUCL salutes her courage for breaking the silence on rape and sexual intimidation carried out by her senior colleague and editor. We have also admired the consistent and principled manner in which the young girl stated her case, initially via internal emails within Tehelka, and later on to the media, neither allowing vituperation or anger at the blatant violation of her body to sensationalise her case or to prevaricate about the fact of the offence having been committed. Through her dignified stand she stands as a model to all women who suffer similar sexual violence, that the dignity of a woman’s body cannot be a plaything for anybody howsoever influential and powerful they be. By the same token, we also denounce the vilification campaign carried out by Tarun Tejpal and his lawyers against the complainant by seeking to impute that the entire crime was actually a `consensual’ act or at trying to trivialise the crime by calling it “light hearted banter”.

The Misogyny of India’s Cultural Elite: Kavita Bhanot

Thanks to the brave actions of a woman who had the courage to speak out against her very powerful boss, something huge has happened in the last week in India. The very sophisticated, cosmopolitan English-speaking cultural elite of India has been forced, for once, to look at itself, to face up to the sexism and misogyny that it has long harboured.

For many years this elite has been protesting, exposing, judging, mocking the patriarchy of the lower classes – of the policeman, the religious fundamentalist, the ‘unpolished’ politician, the working class urban migrant, the eve-teaser on the street.  But rarely have the men, or the women of this class, looked, in public, at themselves – the men examining their attitude towards women and the women thinking about their own complicity, the ways in which they have allowed or turned a blind eye to the misogyny of the men of their own class.

Neither the incident, nor Shoma Chaudhury’s response to it, surprises me in the least. In the time that I spent in this world, it became quickly apparent to me that deeply entrenched in the suave, cosmopolitan world of English language media, literature, art – were problematic attitudes towards women that neither the men or the women seemed to question.

Not an open letter to Tarun Tejpal: Hartman de Souza

When I hit out at him, Tejpal stood there with a swagger and a go-fuck-yourself smile on his face. Butter doesn’t melt easily in this guy’s mouth; he was smug when he said he hadn’t run Raman Kirpal’s story on the mining scam in Goa (that he himself had commissioned mind you) because it was not good enough for Tehelka.

 “There were no hard facts, man,” he said, his voice exiting his quasi-American accent in a nasal peeve, “just a lot of conjecture”.

He actually asked me whether I had read his magazine. Probably never even saw the eulogy I wrote for Tehelka, on that magnificent footballer from Kerala, VP Sathyan, who threw himself in front of a train at the age of 41 just plain bloody tired of being broke and ignored.

On July 18, 2006, when Sathyan, stupidly, stopped believing in the beauty of football, Tejpal’s star was in its ascendancy. That was the day – nearly a year and a half after Tehelka shed blood, sweat and tears, that the CBI also charge-sheeted former BJP President Bangaru Lakshman for ‘allegedly’ pocketing money from a fictitious armament firm and influencing a weapon deal.

That’s the ‘scoop’ that put Tejpal on the ladder – and just so that we all know what is what, people still don’t give a shit about VP Sathyan who in 1992 captained what is arguably Kerala’s  best ever football team.

Eight years ago I remember listening to Tarun Tejpal in Bangalore as he held forth on how the news media could change the world for the better. It was a gathering of journalism students from Catholic institutions around the country and Tejpal was impressive in his defense of media freedoms.

He was passionate, charismatic, extremely articulate and as Chief Editor of Tehelka- with some of the best stories of Indian journalism behind them- very credible too. Feminists condemn the BJP lynch mob attack on Shoma Chaudhary

This is the text of the statement released yesterday condemning the  attack on Shoma Chaudhary by a BJP mob led by Vijay Jolly.

We condemn the BJP lynch mob that attacked Tehelka managing Editor Shoma Chaudhuri’s house, physically jostling her at the entrance. Unsurprisingly, the BJP and right-wing forces in general have pounced upon the Tehelka sexual assault case to sweep attention away from the sexual crimes of their own Asaram Bapus and their Sahabs.

While Shoma Chaudhuri failed in her responsibility as an employer when approached by an employee complaining of sexual harassment within the organization, she is neither an accomplice nor an accessory to the crime of sexual assault of which the Tehelka Editor Tarun Tejpal is accused.

We also condemn the online harassment meted out to other women employees in Tehelka by the right wing brigade in the internet. Such harassment is only further evidence of the double standards of the right-wing forces who see this attack on the woman journalist as a political opportunity.

Sexual harassment and violence against women respects no political boundaries, and we are appalled that a party responsible for large scale violence against women should present itself as the saviour of women’s rights, and that, through a physical attack on a woman journalist. We recognize the distasteful political pre-election opportunism at work in these self-righteous stands by an ethically bankrupt party, and demand that Shoma Chaudhuri’s safety be assured by the state.

Former Tehelka journalist speaks out

This is the full text of the statement issued today to the media by the gutsy woman journalist who refused to take sexual harassment as routine. More power to her and others like her!

I am heartened by the broad support I have received over the past fortnight. However, I am deeply concerned and very disturbed by insinuations that my complaint is part of a pre-election political conspiracy.

I categorically refute such insinuations and put forward the following arguments:

The struggle for women to assert control over their lives and their bodies is most certainly a political one, but feminist politics and its concerns are wider than the narrow universe of our political parties. Thus, I call upon our political parties to resist the temptation to turn a very important discussion about gender, power and violence into a conversation about themselves.

So Tejpal allegedly sexually assaulted his lady colleague in an elevator. Criminal charges have been pressed against Tejpal and it seems sooner or later the woman journalist who may not get another job any time soon will at least get justice.

About time we discuss another TEZpal. This one had also harassed a lady colleague in an elevator. That was in 2007. TEZpal after having asked the woman journalist very personal details about her boyfriend repeatedly had not understood she was “not interested”. One night while TEZpal was the shift in charge of the night shift he tried  kissing and hugging this lady colleague in the office lift.

The woman journalist had reported  the incident to her bosses. An internal investigation was done. Many other journalists were called. They asserted that  TEZpal was indeed sexist and out of line a little much too often. Some old HR exit interviews were brought out. TEZpal was asked to leave.

But, all this was done quietly. This was also an “Internal matter” you see.

Feminist interventions and the agency of the survivor: A Statement

We write as feminists and activists in the women’s movement, disturbed by imputations of motive to some fellow activists who have spoken out publicly in the Tehelka sexual assault case. These allegations of pandering to the Tehelka management’s attempts to cover up the serious charges against Tarun Tejpal, have come expectedly from the Right, but also disturbingly, from sections of the Left, who interpret the insistence on respecting the decisions of the complainant, as disrespect of the law on sexual assault.

Many of us have been in the position of being confidantes to women who come to us with complaints of sexual harassment and assault. In such situations, we see our prime responsibility as that of offering unconditional support to the complainant, making available to her the largest possible range of options, helping her to take difficult decisions. Among these options is always the recourse to the police and criminal prosecution. But we believe it would be entirely counterproductive to insist that the complainant report to the police if she is not prepared to do so immediately. And until she expresses her readiness to move forward on that path, we try to build her courage to take that step, while remaining quietly supportive of whatever steps she does wish to take in the interim.

The Tangled “Tonalities” of Mr. Tejpal

By now the details are well known: a young journalist describes a harrowing encounter with Tarun Tejpal, owner and editor of Tehelka, in an elevator during Tehelka’s Think fest in Goa. The description of the incident alleges gross sexual misconduct and bodily violation of an aggravated nature.  Her description does not make for easy reading: it clearly demonstrates the incredibly vulnerable position in which young women are placed when confronted with the sexual misdemeanors of powerful men in positions of managerial authority. Indeed Mr. Tejpal says as much, that to cooperate with him is the best way for her to keep her job. She writes to Ms. Shoma Chaudhury the managing editor describing the incident and asks that she be tendered an official apology, and that Tehelka’s senior management constitute an enquiry and anti-sexual harassment committee as per the Vishaka guidelines. Instead what she is offered is a pathos-laden tale of fall and redemption: directed by and starring Mr. Tejpal, producer Ms. Shoma Chaudhury. There has been near continuous discussion across the web and the news and it can get difficult to keep track of all the various versions being produced on an hourly basis by Tehelka’s bullshit factories. 21 वीं सदी की दूसरी दहाई में जबकि संविधान लागू हुए साठ साल बीत गया हो और अस्पृश्यता को उसके तमाम रूपों में समाप्त करने को लेकर आधिकारिक ऐलान किया गया हो, तब क्या इस बात की उम्मीद की जा सकती है कि किसी प्रार्थनास्थल पर बाकायदा बोर्ड लगा कर अनुसूचित तबके के लोगों के प्रवेश पर पाबन्दी की बात लिखी गयी हो। अपने विपुल रचनासंसार से एक अलग छाप छोड़ने वाले साहित्यकार एस आर हरनोट पिछले दिनों इसी मसले को लेकर चर्चा में आए, जब उन्होंने हिमाचल के एक चर्चित मन्दिर में ऐसे ही बोर्ड देखे।

देश के अग्रणी दैनिक (द हिन्दू) में प्रकाशित रिपोर्ट के मुताबिक श्री हरनोट ने बिलासपुर जिले के प्रख्यात मार्कण्डेय मंदिर के प्रबन्धन के खिलाफ प्रथम सूचना रिपोर्ट दर्ज करानी चाही क्योंकि वह अनुसूचित जातियों के सदस्यों के साथ खुल्लमखुल्ला भेदभाव कर रहे थे । एक बयान में उन्होंने बताया कि मंदिर प्रबन्धन कमेटी ने दलितों के मंदिर प्रवेश पर पाबन्दी को लेकर बाकायदा बोर्ड लगाए हैं।

Protect the Privacy of the Tehelka Journalist: Report Responsibly

To all editors, journalists, bloggers, users of social media, and the public:

Some websites and blogs are posting the Tehelka journalist’s complaint to the magazine’s management or reproducing parts of it, perhaps with intent to expose a grave act of sexual assault by a man occupying a powerful position. However, in doing so, they are violating basic ethical and legal injunctions on the way cases of sexual assault must be reported.

The journalist’s complaint to her company is a private document and not a public one. While private documents can be leaked in the ‘public interest’, this principle is applicable to the emails of Tarun Tejpal and Shoma Chaudhury sent to Tehelka staffers, not to the journalist’s emailed complaint. In cases of sexual assault, it is a well established principle that the media can name the perpetrator, but not the victim. The identity and privacy of a victim must be protected at all costs.We are distressed that many people are circulating the journalist’s emails, and other journalists, bloggers and users of social media are publishing it in parts or whole.

Sexualized workplaces, predatory men and the rage of women

Listen. Can you hear it? That low growl on the horizon, coming closer, growing louder? It’s the dam bursting its bounds. It’s the quiet shriek of convivial silence being ripped apart.

The silence around the normalizing of a range of behaviour from the apparently casual to the outrightly violent. The laughing sexual innuendo; the misogynist jokes; the well-known ‘displaced squeeze’ of the upper arm, the shoulders; the repeated, relentless expression of romantic or sexual interest despite clear NO’s; the grabbing of the breast, the unwanted kiss, the out-of-town work trip ending in physical assault, presented as flattering interest; and through it all, the clear invocation of the power relationship.

You look great, Sir, retirement suits you, says a younger female colleague to a Professor visiting his former institution. Really, he smirks. Two other people told me this, and they are both women. What do you think it means? She smiles uncomfortably and hurries out of the office of the male head of the institution in whose presence this comment is made.

The Bharatiya Janata Party or BJP will honour its legislators accused of inciting communal violence in Muzaffarnagar at a rally to be addressed by Narendra Modi in Agra on Thursday.

The BJP’s legislators in the Uttar Pradesh Assembly, Sangeet Som and Suresh Rana, were jailed in September after the stringent National Security Act was imposed on them for their alleged role in the Muzaffarnagar riots…Mr Som, accused of uploading a video on his Facebook wall which reportedly sparked communal tension in the area, was arrested in Meerut on September 21. He is also facing allegations of having made inflammatory speeches.Mr Rana was arrested from Lucknow on September 20 for his alleged role in stoking the violence which left over 60 people dead and rendered more than 40,000 homeless.

It was a gathering not much reported outside the Hindutva laboratory. After their humiliating defeat at the hustings at the centre (Year 2004) it was the first meeting of its kind which witnessed coming together of many stalwarts of the Sangh Parivar to felicitate one among them. One could see all the big names of the Parivar hierarchy— the ex deputy PM L.K.Advani, Narendra Modi and the likes of Togadias and Singhals, and a galaxy of saffron robed sadhus. The programme held in Ahmedabad to felicitate Prof Keka Shastry, VHP leader and a well-known writers’ entering the centenary year seemed an ideal occasion for them to air their views in Gujarat.

1997 में आयी वह आत्मकथा ‘‘जूठन’’ आते ही चर्चित हुई थी। उस वक्त एक सीमित दायरे में ही उसके लेखक ओमप्रकाश वाल्मिकी का नाम जाना जाता था। मगर हिन्दी जगत में किताब का जो रिस्पान्स था, जिस तरह अन्य भाषाओं में उसके अनुवाद होने लगे, उससे यह नाम दूर तक पहुंचने में अधिक वक्त नहीं लगा। यह अकारण नहीं था कि इक्कीसवीं सदी की पहली दहाई के मध्य में वह किताब अंग्रेजी में अनूदित होकर कनाडा तथा अन्य देशों के विश्वविद्यालयों के पाठयक्रम में शामिल की गयी थी।

उपरोक्त आत्मकथा ‘‘जूठन’ का वह प्रसंग शायद ही कोई भूला होगा, जब सुखदेव त्यागी के घर हो रही अपनी बेटी की शादी के वक्त अपमानित की गयी उस नन्हे बालक (स्वयं ओमप्रकाशजी) एवं उसकी छोटी बहन माया की मां ‘उस रात गोया दुर्गा’ बनी थी और उसने त्यागी को ललकारा था और एक ‘शेरनी’ की तरह वहां से अपनी सन्तानों के साथ निकल गयी थी। कल्पना ही की जा सकती है कि जिला मुजफ्फरनगर के एक गांव में – जो 21 वीं सदी की दूसरी दहाई में भी वर्चस्वशाली जातियों की दबंगई और खाप पंचायतों की मनमानी के लिए कुख्यात है – आज से लगभग साठ साल पहले इस बग़ावत क्या निहितार्थ रहे होंगे। उनकी मां कभी त्यागी के दरवाजे नहीं गयी।

इस नन्हे बालक के मन पर अपनी अनपढ़ मां की यह बग़ावत – जो वर्णसमाज के मानवद्रोही निज़ाम के तहत सफाई के पेशे में मुब्तिला थी और उस पेशे की वजह से ही लांछन का जीवन जीने के लिए अभिशप्त थी – गोया अंकित हो गयी, जिसने उसे एक तरह से तमाम बाधाओं को दूर करने का हौसला दिया।

श्रीलंका अभी खबरों में है. लेकिन ज़्यादातर हिंदी अखबारों को पढ़ने से आपको अंदाज़ नहीं मिलेगा कि सुदूर दक्षिण में स्थित इस नन्हें-से मुल्क में क्या कुछ हो रहा है जिससे हमारा भी रिश्ता है.वहाँ अभी‘कॉमनवेल्थ’ देशों का सम्मलेन हो रहा है और हमारे प्रधानमंत्री उसमें शामिल नहीं हो पा रहे हैं.श्रीलंका ने कहा है कि वह उनकी मजबूरी समझता है. तमिल राजनेताओं के हंगामे की वजह से प्रधानमंत्री ने अपनी जगह विदेश मंत्री को इस सम्मलेन में भारत का प्रतिनिधित्व करने को कहा है. इस सम्मलेन में श्रीलंका को अगले दो साल के लिए ‘कॉमनवेल्थ’ का नेतृत्व करने को कहा जाएगा. इस पर भारत को ऐतराज नहीं है और अब तक किसी और मुल्क ने भी अपनी आपत्ति दर्ज नहीं कराई है. First Terrorist of Independent India

…Government have, however, noticed with regret that in practice members of Rashtriya Swayamsewak Sangh have not adhered to their professed ideals.

“Undesirable and even dangerous activities have been carried on by the members of the Sangh. It has been found that in several parts of the country individual members of the Rashtriya Swayamsewak Sangh have indulged in acts of violence involving arson, robbery, dacoity and murder and have collected illicit arms and ammunitions. They have been found circulating leaflets, exhorting people to resort to terrorist methods, to collect firearms, to create disaffection against the government and suborn the police and military.”

On Nathuram Godse, (19 th May 1910 – 15 th Nov 1949) Advani asserts that Godse had “severed links with RSS in 1933… had begun to bitterly criticise the RSS”. This was flatly contradicted by none other than Godse’s brother Gopal, who was also an accused at the trial for conspiracy to murder. He published his book Why I Assassinated Mahatma Gandhi in December 1993. Speaking in New Delhi on the occasion of the release of his book, Gopal Godse revealed what many had suspected—they had both been active members of the RSS (The Statesman; December 24, 1993).

What could be said to be the first act of terrorism in independent India?

Everybody would agree that killing of Mahatma Gandhi by a Hindu fanatic Nathuram Godse constitutes the first terrorist act in independent India. Godse, a Maharashtrian Brahmin, hailing from Pune was associated with Hindu Mahasabha at the time of Mahatma’s assassination and had his initial forays in the world of politics with the RSS. During his tour of the area Hedgewar, the first supremo of RSS, use to be accompanied by Nathuram , the future assassin of Gandhi. The 2014 elections aren’t merely about changing the government. The rhetoric ahead of the polls makes one believe that it’s an attempt at once to change historical narratives handed down to successive generation of Indians. And the man in the forefront of it all is the BJP’s prime ministerial candidate Narendra Modi.

Wordsmiths of the world need to put in their heads or pull in their socks (you may say) to coin a new word which can rather resonate with what goes on in this part of South Asia in the name of political speeches. Should one call it ‘polifiction’ or ‘politainment’ or some similar word.

Perhaps a word exists and this poor pen pusher is ignorant about it.

Anyway, the matter has become bit urgent with the feverish preparations which are going on here for the battle royale which would take place in the year 2014 and the not so silent emergence of NaMo on the national scene and the daily dose of half truths, fiction and complete distortion which goes under the name of oratory. अमर नश्वरता का कथावाचक: विजय दान देथा

मृत्युहीन अमरता से बड़ा अभिशाप और कुछ नहीं, विजयदान देथा की एक कहानी में एक कौवा सिकंदर को सीख देता है. फिर भी मृत्यु से दुखी न होना मनुष्यता के विरुद्ध है,यह भी हम जानते हैं. इसलिए कि प्रत्येक व्यक्ति अपनेआप ही ऐसी क्षमताओं और संभावनाओं का आगार है जो उसके अलावा और किसी के पास नहीं होतीं. हमें पता है कि उसके जाते ही वह सब कुछ चला जाता है जो उसने अर्जित किया, संग्रह किया और फिर उसके बल पर  गढ़ा. वह संग्रह और गढ़ने की वह ख़ास कला भी उसके साथ चली जाती है.दुख इससे  हमेशा के लिए वंचित हो जाने का होता है.विजयदान देथा के जाने से हुई तकलीफ और खालीपन दरअसल इस बात के अहसास से पैदा होता  है कि जो प्रयत्न उनके द्वारा संभव हुआ और जिसने प्रसन्न कला का रूप ग्रहण किया, वह कितना विराट और दुष्कर था, इसका आभास हम सबको है.
