Some Reflections on Rape in India: Bobby Kunhu

A couple of days back, representatives of a group that wanted a petition demanding death penalty for all the accused in the Chennai gang rape case sought an appointment with me. I had clarified that I will not be part of any process demanding death penalty and would be glad to meet them on any other discussion they might want on the case. While, I managed to convince those who met me that death penalty cannot be a deterrent against rape, I suggested that instead of the petition they should spend their efforts to energize a change in the current discourse on rape in whatever small ways possible. The meeting ended with plans of a more substantive plan of action to discuss possibilities of advocating accessible spaces for children vulnerable to physical or sexual abuses at least in the neighborhood. I have summed up some of the points that I made at the discussion and I thought it would be important to share them with a wider audience.

JNU Faculty Stand With The Women Students Of SLS

We, the undersigned teachers of Jawaharlal Nehru University, are deeply distressed to read about extremely grave allegations of moral turpitude against Prof. Atul Johri, amounting to charges of sexual harassment, academic dishonesty, and financial misappropriation. We now hear that seven women have made police complaints. Coming on the heels of recent media stories that Prof. Johri was involved in the forgery of assent by leading scientists in a signature campaign, we are appalled by the university’s silence about an individual that it has vested with so many offices. Prof. Atul Johri is the Director of the University’s Internal Quality Assurance Cell, the Director of the Human Resource Development Cell, a warden, and the Vice-Chancellor’s favourite nominee on several committees.

We demand that Prof. Johri be immediately removed from all these positions, as the allegations against him bring great disrepute to the university. We expect the university to take all the requisite measures to investigate the charges that may be brought against Prof. Johri and to pursue them to their logical conclusion.

As faculty who have fought for and long supported the GSCASH, which this administration has shut down, we are distraught that complainants have had to take charges that should have been pursued within the institution to the police, because of a lack of faith in the university’s internal complaints committee nominated by the Vice Chancellor. We support the complainants’ exercise of their rights to approach the police, but rue the fact that the illegal and immoral dissolution of GSCASH has resulted in a situation in which no aggrieved person seems to have any faith in the delivery of justice within the institution on matters of sexual harassment. This is the second such case when allegations about sexual harassment have been filed under the IPC, because complainants do not have faith in the autonomy, impartiality, and commitment to complete confidentiality of the JNU ICC. We would like to emphasise the complainants’ rights to approach the police with their complaints must be respected and protected, and that the complainants must be given full protection against victimisation and full cooperation by the university authorities in pursuing their complaints.  Continue reading JNU Faculty Stand With The Women Students Of SLS

In the wake of the AUD report

This post is not a statement from the Kafila collective, but my individual response to the news about the Ambedkar University report having found Lawrence Liang guilty of sexual harassment. This response will also address some of the comments that were posted on the Kafila statement posted yesterday.

We learnt from media reports that a duly constituted committee of AUD has found Lawrence Liang guilty of sexual harassment. We did not know about this earlier, as some characteristically self-righteous and ill informed twitterati assume we did. Those whose social concern and activism is limited to busy fingertips obviously have no idea about the processes that have been carefully put in place in sexual harassment policies in universities, which protect confidentiality primarily to protect the complainant. So the first we heard of the leaked AUD report was from the media. Lawrence’s own statement was then issued that says that he plans to appeal this decision. This statement too we saw in the media.

From enquiry to report to appealing the decision (which can be done by complainant or accused) – these are all established stages of due process that feminists have worked for decades to establish, from the Vishakha judgement of 1997 onwards. That judgement itself was a result of feminist intervention. I do not understand ‘due process’ as a technicality alone, nor do feminists in general who have worked with women and men complainants on this complicated issue, especially in a context of power in academic contexts. Breastfeeling, not Breastfeeding

The raging controversy over the cover of a breastfeeding woman looking up with no shame about her exposed breast has, quite expectedly, sent conservative fools in Kerala into a raving frenzy. The case against the model and the conservative breast-beating going on now must be dismissed summarily as useless bullshit.
However, I must say that I had very mixed feelings about the cover and the defense offered for it by many. For many arguing in its defense seem to be saying that all one needs is gratefulness for the effort to open up the issue and the space gained, and all else raised isn’t really worth the trouble. Even this intelligent piece in the Ladies Finger slides into such complacency.

If you ask me, this cover is not of a woman breastfeeding, but of one who is declaring her determination to be comfortable while breastfeeding, thereby reinforcing her commitment to breastfeed her baby. I think this difference is important. Breastfeeding is a very intimate act; it is highly physical. If the mother and child are well, happy, and don’t have issues that may make this feel like a chore or hard to do, then it is very highly pleasurable too. As a woman who has breastfed continuously for 9 years with just a short break of a few months during my second pregnancy, I can say this: breastfeeding is also ‘breastfeeling’, so your attention is on the act, and you really don’t want to focus on anything else, especially irritating stares. It is as pleasurable as lovemaking. Many years later (my daughters are 25 and 20 this year), when I remember the act, my nipples rise, tingling. Breastfeeding was also play time, when the little one played with her mum’s breast with her tiny fingers feeling and squeezing it; and my younger one was especially playful, twisting her tiny body in sheer pleasure, and sometimes, remaining still and then naughtily sinking her little tooth into the nipple, rolling her eyes up to check the reaction from her mum! So when we traveled, I always carried a big, opaque duppatta with which I made a ‘tent’ over our heads that covered us completely. We would be sitting in a corner seat in the train, and having fun, she sitting on my lap (and later the tent would be big enough for the three of us, myself, my six-year-old, and one-year-old, the former listening to a story, and the latter happily suckling). We would sing, tickle, do what not. Demanding the freedom to breastfeed without being too bothered about modesty and in public without anyone staring, for me, then, is demanding the right to such intimate pleasure in public. In that sense, this should have been one of the afterlives of Kerala’s Kiss of Love protests.

I don’t have the image of me breastfeeling happily, but here is the picture of my little one after one of our sessions. Does anyone doubt anymore, that it is indeed breastfeeling, not just breatfeeding. Here is she, looking ecstatic, the milk still in her little mouth!
However, the sartorial codes of the model make me feel very disconcerted. Sharanya Gopinathan, in the above piece, argues that Grihalakshmi caters to largely savarna women probably. But no, savarna women are not the demographic majority, and they are possibly not the dominant section in the magazine’s readership. But savarna culture is pervasive in Kerala, cutting across caste and faith, and the cover clearly panders to it. The model’s huge sindoor — mark you, wearing the sindoor is a very recent import from the north to Kerala, the demure-looking sari, and the girl-next-door look was probably calculated to make up for the exposure of the breast. So we have a young woman who announces through her sindoor that she is married — legally and customarily penetrated, to adopt a Foucaldian way with words — and modestly dressed, that she belongs to the elite, evident in her professionally-groomed looks, and also tells the world that she is determined to breastfeed no matter how much the lechs stare. Intended or not, it brings to the mind too readily the dream-girl of the Hindutva modernist vanguard: the educated woman, maybe even a corporate professional, with looks that fit that environment, who is determined to mother well and indeed stay close to her biological ‘essence’, and of course whose maternity has not been allowed to affect her slim body and maidenly-looking breasts. The idea, I think, was to say that such a woman can and should be brave enough to fend off irritating stares — but it backfired with the conservatives, apparently, who are not ready to concede any quarter. Breastfeed she must, remember her womanhood, she must, look pretty and stay slim she must — and demand no open breastfeeding.
When will we see the image of a woman you see in the bus stops every day in Kerala, harried, sweaty, with her budget-beauty parlour looks and less-than-chic sartorial choices sitting in a bus shelter perhaps and immersed in feeding her infant, her not-perfect breasts bulging out un-prettily, caring nothing at all for what the world thinks? She can of course be imagined as staring back defiantly, but the glow of pleasure is what should animate her being and fill her with courage. Normination to be a good biological woman and mother. Not the developmentalist commitment to produce healthy babies. What ultimately counts is the space of intimacy between a mother and her child, which is physical, which involves pleasure — and we need to demand that women should be able to create it everywhere.
And why on earth are we waiting for Grihalakshmi to lead? Thankfully, third wave feminism in Kerala is devoid of prudishness and values pleasure — and among our third gen we have a great many artists — poets, painters, photographers, of many genders! We should be able to assert that what is at stake is breastfeeling, not just breastfeeding. Let us reduce ourselves to neither those who sneak in a litany to biological motherhood through their seemingly radical cover, nor with those who want to see nothing but physical nourishment in breastfeeding.

From Nangeli to Rima Kallingal: Who are fit to claim Nangeli’s Legacy?

The recent reference to how the distribution of food in Malayali homes is often skewed against women by the actor Rima Kallingal in a recent talk has sparked off yet another round of attacks against feminists in Kerala. It is interesting to see how this seems to have brought together men of all political stripes and colours (may I say, from pro- and anti-Hadiya camps!). The attacks range from mild smirking to outright abuse, but are equally revealing of the fear of women’s feminist self-assertion. So even those men who supported Hadiya’s decision to choose her faith and community find it hard to swallow when women start laying bare the injustices of the ubiquitous patriarchal family, fearing that there may be an implicit choice in this criticism, to move away from the patriarchal family, and indeed, craft other non-patriarchal forms of intimate connection and commitment. An open letter to Brinda Karat: why do female supporters of the Kerala CPIM spew such venom at Hadiya?

Dear Comrade

I can hardly describe the joy and relief I felt reading your piece on the Hadiya case in the Hindu yesterday. By now I am nearly deaf from the cacophony of misogyny, islamophobia, and sheer short-sighted rage that CPM supporters on Facebook are unleashing against this young woman.

Your voice of sanity, Comrade, is therefore a great restorative. If not for your writing, one could have well thought that the CPM was nothing more than a bunch of short sighted, power hungry, strategisers, whose total lack of ethics and values is covered up by a vapid, outdated rationalism and an equally problematic liberalism. You refuse to condemn Hadiya for choosing Islam. You acknowledge that she is brave. You unequivocally reject the father and other minions of patriarchy. You rightly criticise state patriarchy evident in the Supreme Court. Unlike many CPM supporters here, you have no illusions about the times we live in; you are clearly aware that the NIA is not something which will spare us if we stay good. Importantly, you put paid to the idea that the High Court judgement that sanctioned her illegal custody was justified — an idea assiduously nurtured by certain public figures allied with the CPM against religious Muslims. Comrade, thank you again for being so forthright and in the face of snarling islamophobes in your own ranks actually gunning for the voice you raised against her illegal custody long back.

The Gates of Vaikuntam?

When Hadiya Shafin shouted to the crowd that she converted voluntarily, that Shafin was her chosen husband, and that she wished to spend her life with him, some leading rationalist liberal feminists in Kerala sniggered at her: be grateful for the Indian Constitution which allows you to make a choice. This statement hid a despicable insult to her choice of Islam, slyly implying that it would not permit her any choices.

Goodness knows where these puerile, vain, indurate minds live their everyday lives.  Maybe they are either still able to insulate themselves somehow from the onslaught of Hindutva violence, or find it useful to use the arms of this Hindutva hegemonised thuggish state to their narrow, shamefully narrow, ends.

Whatever, I could see no trace of the protective presence of the Indian Constitution when the Supreme Court heard Hadiya. I could see not the highest court of Justice of a vibrant democracy but I got a sense of how the Gates of Celestial Vaikuntam may look like:

[Statement]: Women Against Sexual Violence and State Repression (WSS) on the on-going conversation on “The List”

The following is a statement by WSS on the lists of sexual harassers being circulated on social media. We reproduce it here as part of the ongoing dialogue on the issue.

Women Against Sexual Violence and State Repression (WSS) stands
firmly with the survivors who have faced sexual harassment at the hands of the
perpetrators on and off the list and, most importantly, extends solidarity in this
moment of unravelling narratives, disjointed arguments and personal struggles of
individuals voicing their experiences.

The last few weeks have seen lists of sexual harassers in academia and civil society published and circulated on social media, statements issued by groups of persons and individuals reflecting on the lists, and questions raised on the ways of dealing with such lists, perpetrators of harassment, and the mechanisms in place to address it.

Alongside the lists and statements, there has been a marked silence from some of the avenues that normally engage with sexual violence and harassment, both within and outside academia. While social media was abuzz with discussions and debates, now, once again, there is silence. As a collective standing against sexual violence and state repression, we recognise that institutional spaces can be fraught with sexual violence of varying kinds and, sometimes, despite systems and processes in place, the journey of seeking justice for each individual can be a long and lonely one. Was the ‘Dancing Girl’ of Mohenjodaro actually a warrior?

NAMAN AHUJA, art historian, asks an exciting question that reminds us that the interpretation of artefacts, indeed, interpretation as such, is inevitably framed by the context of the viewer, and therefore always open to rethinking.

The image below is one that we are all familiar with, the exquisite sculpture of the ‘Dancing Girl’ found at Mohenjodaro.

Naman Ahuja, speaking to Anindita Ghose, suggests that the reading of this image as a dancing girl can be attributed to a perspective arising from the normalizing of patriarchal values prevalent in contemporary society. Ahuja offers an alternative reading that is much more persuasive:

The figure has bangles all the way up her left arm but her right arm is bare, as any working person would have it. A decorated left arm and a bare right arm free for labour…or for war? If she was a dancing girl by profession, surely it would have been relevant to keep both arms decorated? Look at the way she is standing. Look at her confidence. One arm on hip. Head thrown back. The way her hand is sculpted, there might have been a spear in her hand. Is she a warrior figure? Could she be a soldier rather than a dancing girl?

Thoughts on the Continuing Assault on Women’s Rights and Progressivist Gaslighting in Kerala

After the atrocious indifference and trivialisation of domestic violence displayed by the sneering alpha-male brigade of the CPM during the discussion of the Hadiya Case, nothing surprises me. However, it appears important to point out how such callousness is indeed becoming normalised here alarmingly. It seems that the gains of women’s movement which made violence against women at home something beyond an intimate private affair, a ‘family quarrel’, are being steadily depleted. Of course, we did see how so many smooth-talking liberal CPM-oriented or purportedly-rationalist young male intellectuals went ballistic at the mere suggestion that they are blind to the domestic violence in Hadiya’s imprisonment. Also intriguing was their persistent defense of the father’s right to keep an adult, mentally fit, educated daughter immobile and imprisoned because he feared for her safety. Political discourse in the contemporary period is by marked an affective intensity. Regardless of the issue an acute depth of feeling is in evidence. Righteousness, betrayal, entitlement, anguish and aggression suffuse arguments across the political spectrum. What seems at stake is not merely the desire to speak but to have the terms of one’s discourse deemed legitimate, to be understood as one understands oneself. The sizzle, crack and snap of rhetoric expresses the heightened temperature. One could credibly interpret it as the sound of an existing order breaking down under multiple pressures. This would however be a partial explanation. The surcharged atmosphere is equally evidence of the ties that bind those passionately disagreeing with each other. And therein lies a clue. Statement by concerned citizens on the continued incarceration of Hadiya

We, the undersigned concerned citizens, are greatly disturbed by news reports of the NCW in-charge, Rekha Sharma’s visit to meet Hadiya at the home of her father, Mr. Asokan, where she continues to be incarcerated. These reports raise more fears than they allay.

Ms Hadiya has been reported by Ms Sharma to be ‘healthy and happy’. However, Ms. Sharma goes on to state, without providing any evidence whatsoever, that while there is no ‘love jihad’ in Kerala, there are forced conversions.

It bears reiteration that Ms. Hadiya is a twenty four year old adult woman, who took a decision to convert to Islam, and then to marry a Muslim man. For this exercise of self determination, Ms. Hadiya has been placed under house arrest in her parents’ control, and this shocking violation of Ms. Hadiya’s personal liberty and her right to take decisions about her own life, has been endorsed by the legal system.

Notes on a Feminist Crowdsourced List of Sexual Harassers: Nandita Badami

In the wake of the extreme disagreements we have witnessed in these past few days, there is perhaps no point (at least, not anymore) in staking a claim about whether or not the list should have been created or circulated to begin with. The list is here, and it will most likely stay. It has, as Rama Lakshmi has pointed out in an extremely insightful Facebook post, inaugurated a new moment in the Indian feminist movement. And despite their many concerns, I doubt that even the most vocal anti-listers will deny the cathartic role it has played for some women.

Perhaps the time has come then, to think seriously about how to engage with the list: not simply declare allegiance, or deny legitimacy, but to start thinking about how to work towards bettering what many (both pro- and anti-listers) find to be problematic with it. To at least try to create genuine feminist dialogue about what a crowdsourced list of sexual harassers could look like – starting not from the content, but from the form and format of the list itself. To all the men, women, and all those of named and unnamed genders in my life, intimate, private and public, who have shown me safety, joy, pleasure, comfort and love and who ask of me, gently, the same. I love you all.

I was raped when I was 14, Or maybe 15. Not sure. It took me three years to realise it happened. Another ten to choose to begin to deal with it. And another six to realise the details and extent of what happened. And so, the process continues. Far from over. So yeah, #metoo.

When I moved to Delhi I called home crying everyday, not only because I didn’t know Hindi and everyone chided me by calling me madrasi, but because I got sexually harassed everyday. It wasn’t the ‘far away’ whistling kind I was used to in Chennai. I saw penises from unzipped pants in the crushing closeness of Delhi buses. Again, on the bus, I had men masturbate on my shoulders and am still showering to get it off me. So yeah, #metoo.

Once I was older, I acquired some ‘power’ (by my standards) – people had heard of my name from publications, activist work – I was accused or it was implied that I could have sexually harassed or abused two women at two different times. I was in romantic relationships with them. Neither one made the accusation public. Neither one of them were my equals in age, or cultural capital. One of them got in touch many years later and tried to establish a friendship again while implying that she never meant to make me feel that way. But I was too scared to even respond. The other was much closer to me and so I said more and she said more to me. She was the one I had a physical relationship with. I will never forget that feeling of power, enormous self doubt, and painful reflection. I will always ask myself what my intentions were, how I may have expressed them and why I wasn’t able to negotiate power in a way that was adequately and appropriately dignified, respectful, kind and most importantly equal-ising.

There was no time to strategise, no time to theorize, no time to bargain and no time to compose ourselves for the next day’s onslaughts. And yet, the onslaughts never abated. The mundane was coupled with the spectacular, the anti-national with the terrorist, the intellectual with the condom-user, the dissenter with the stone-pelter, and the everyday with the genocidal. Failings Foretold – Reflections on the Unreflective Masculinity in the Time of the List: R Srivatsan

It is with a recognition of a failing foretold that I read the different posts, letters and conversations around the list (the unmistakable one today).  That one’s teachers, seniors, peers and respected fellow academics have been named as having sexually harassed women cannot be digested without trouble.  I struggled to comprehend what had happened and went through all the emotions of denial and outrage, followed by shock, acceptance and hopefully a slowly emerging wisdom.

It then came back to memory that I too have sexually harassed women on three occasions.  However, I was in anonymous situations which were not explicitly relationships of power or authority.  And I did withdraw an overture (or a pass, to call it out by its name) when rejected.  Perhaps I have been cautious in not letting my shenanigans come back from the past to bite me.  Or perhaps I cleverly chose occasions and situations that would not be traceable to me.  Also, most importantly, perhaps those women who could have named and shamed me have been kinder and gentler than I deserved.  Finally, if I were a successful teacher today, perhaps my name too would have been on the list.  This response is based on the recognition that I virtually am.

I write this from my persynal discomfort with Prof.Menon’s recent response – this, although situated in the ‘Name and Shame’ debate, doesn’t derive anything more than grounding from it; this response is based on what Prof. Menon writes in the blog, and my somewhat naïve, but absolutely honest thoughts about it.

Firstly, I would like to myntion my constant and almost stagnant disapproval of how our loci as feminists are suddenly becoming one of legal negotiation – I refuse to engage in such a form of reimagining of feminism that, as she duly points out, has taken decades to strengthen its voice. She, in her response, points at ‘an atmosphere in which Indian courts are increasingly referring to ‘false’ complaints of domestic violence, and ‘misuse’ of rape laws, it is incumbent upon feminists to establish to the extent possible, context and explanation around our claims of sexual harassment’.

In this article I represent none of the other signatories to the statement that appealed for the crowd-sourced list of sexual offenders to be withdrawn, and for complaints to be followed through institutional mechanisms (henceforward referred to as Statement). I might still use the pronoun ‘we’ sometimes, please consider that a slippage; that collective identity is something developed over three decades in a movement, and I hope I never lose that habit. But this is my individually written post. Similarly, after the Statement, Kavita Krishnan has written on Scroll, Ayesha Kidwai on Facebook and Nandini Rao on  her blog, each expanding on some aspect or the other of our brief statement.

Second – the Statement was not and is not a ‘Kafila’ statement, it was simply posted on Kafila. Just as a statement posted on Wire is not a Wire statement or a statement on Scroll a Scroll statement, unless explicitly declared to be. Kafila is a collectively run blog with about 20 members, of which I am one of the founder members. Any member of the collective can post directly on Kafila without checking back with other members of the collective. We have often had robust debates among collective members taking opposing sides on a situation, and these debates have played out on Kafila in the past. Only one Kafila member is a signatory to the Statement, myself. I posted it on Kafila because it is a site which is my first site of preference, whether I am attacking the Hindu right or writing on feminist issues. I asked the other signatories if I could post it here, since I have to ask nobody nor approach anybody to post on Kafila.

Lawrence Liang is also a member of the Kafila collective. He does not ‘run’ Kafila (as has been alleged by many), no individual does. But it seems that in this new era of ‘radical’ politics, individual control and leadership of campaigns is assumed.  Further, Mahmood Farooqui too was a Kafila collective member. When a specific complaint of sexual abuse and rape was brought against him by a complainant anonymous to us, the Kafila collective suspended him immediately from Kafila publicly, pending investigation of the complaint. That was the only collective statement Kafila has issued in its ten years of functioning as a voluntary, non-funded blog.
